Description of Proposal:
BEACH DRIVE HEIGHTS LLC – Access road Timber Harvest Minor/Conversion Option Harvest Permit (COHP) 23-02377, Project grading of approximately 2.5-acres or 28,000 cubic yards of combined cut and fill, for the benefit of nine (9) future single family residential lots in Rural Residential (RR) zoning. Department of Revenue (DOR) forest excise tax # 604549543.
This DNS is being issued for a site development activity permit Grading 3 for an access road only. Plans for further land use activities have not been prepared at this time.
SEPA Determination:
The lead agency for this proposal has determined that it does not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after reviewing a completed environmental checklist and other information on file with the lead agency for consistency with KCC Title 17 Zoning, Title 19 Critical Areas, Title 22 Shoreline Master Program and Title 12 Stormwater. This information is available to the public on request.
Comment Period:
This DNS is issued under WAC 197-11-355 (2); the lead agency will not act on this proposal, 14 days from date of issuance. Comments may be submitted beginning December 23, 2025, and must be submitted no later than: January 6, 2025, at 11:59pm.
The SEPA comment period previously occurred concurrently with the Notice of Application sent out on July 10, 2023.
COMMENTS:
Public Comments received from nearby residents involve stormwater runoff, steep slopes, services access, such as waste collection, deliveries, utilities and Bald Eagle nesting. Comments received from the Suquamish Tribe w
Conditions:
1.
Prior to scheduling a pre-construction meeting with the county, provide the active permit for site clearing and development subject to conditions of the Bald Eagle Management Plan, prepared by the U.S. Department of Fish and Wildlife, otherwise road work must be done outside of the bald eagle management construction allowance which is August 15 thru the end of each year. The nest(s) must be undisturbed from noise within 100 meters outside of the construction timeline from Jan 1 through August 15.

Project shall follow Stormwater controls and provisions in Title 12.

The proposed activity will be conditioned for the protection of wetlands, streams, geologic hazards including slopes and associated buffers per KCC Title 19.200, 19.300 and 19.400.
