Drilling Water Well
NOTICE is hereby given that on January 29, 2026, Clark Living Trust, 714 West Harrison St Chandlier AZ, 85225, filed with the STATE ENGINEER Application No.: LRG-16140-POD3, OSE File No.: LRG-16140-2, for Permit to Change Point of Diversion within the Lower Rio Grande Underground Water Basin of the State of New Mexico by discontinuing the use of well LRG-16140-POD1 located within in the NW¼ of Section 17, Township 27 South, Range 3 East, NMPM, on land owned by the applicant, and drilling new well LRG-16140-POD3, to approximately 200 feet with 4 inch casing, located within the NW¼ of said Section 17, more specifically where points intersect at X=1,512,094.67 feet and Y=350,663.04 feet NMSP (NAD83), on land owned by the applicant, for the continued diversion of up to 3.0 acre-feet per annum, for domestic purposes.. Well LRG-16140-POD1 will be plugged. Old and new wells are located at the physical address of 230 Fig Tree Lane in Anthony, NM.
Doña Ana County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Las Cruces Sun News.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 1680 Hickory Loop, Suite J., Las Cruces, NM 88005, on or before May 1, 2026. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (575) 524-6160. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
