SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS, on September 27, 2018, Jeremy Maness and Heather Maness, husband and wife executed a certain Deed of Trust to Donald G. Griffin, Trustee for the use and benefit of Mortgage Electronic Registration Systems, Inc., as Beneficiary, as nominee for Community Bank of Mississippi, its successors and assigns which Deed of Trust is of record in the office of the Chancery Clerk of Smith County, Mississippi, on October 5, 2018, in Book 0636, Page 1010, as Document Number 201802860.
WHEREAS, Citizens Bank NA f/k/a RBS Citizens NA, the current holder and/or assignee, substituted Halliday, Watkins & Mann, P.C. as Trustee by instrument recorded in the Chancery Clerk's Office on February 6, 2026 in Book 0005, in Page 533, as Document Number 202600308; and
WHEREAS, Default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, Citizens Bank NA f/k/a RBS Citizens NA, the legal holder of said indebtedness, having requested the undersigned Substitute Trustee in said deed of trust, will on April 15, 2026 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the main front door of the County Courthouse of Smith County in Raleigh, Mississippi, to the highest and best bidder for cash the following described property situated in Smith County, Mississippi, to wit:
A 3.70 acre parcel of land located in the Southeast ¼ of Southwest ¼ and in the Southwest ¼ of Southeast ¼, Section 6, Township 3 North, Range 8 East, Smith County, Mississippi, and being more particularly described as follows:
Commence at a G.L.O. monument marking the Southeast corner of the Southwest ¼, Section 6, Township 3 North, Range 8 East, thence run West, 56.0 feet to the East right of way of State Highway No. 35, thence run the following calls along said East right of way: North 12 degrees 39 minutes West 226.1 feet; North 07 degrees 11 minutes West, 133.7 feet; North 03 degrees 29 minutes West, 142.1 feet; North 01 degree 12 minutes East, 148.2 feet to an iron pin for the point of beginning, thence run North 07 degrees 32 minutes East 253.6 feet along said right of way, thence run North 09 degrees 51 minutes East 89.3 feet along said right of way to a blazed line, thence run North 89 degrees 48 minutes East, 469.5 feet along said blazed line to an iron pin, thence run South 08 degrees 36 minutes West 351.7 feet to an iron pin, thence run North 89 degrees 11 minutes West, 465.5 feet to the Point of Beginning; LESS AND EXCEPT a parcel of land described as follows:
Begin at the point of intersection of the Southerly line of grantor's property and the present Easterly right-of-way line of State Highway No. 35 as shown on the right-of-way Appraisal Map for Federal Aid Project No. 46-0023-01-056-10; from said point of beginning run thence Northerly along said present Easterly right-of-way line, an arc distance of 17.313 meters (56.8 feet); thence run South 01 degrees 11 minutes East, a distance of 17.282 meters (56.7 feet) to the Southerly line of grantors property; thence run North 89 degrees 11 minutes West along said Southerly property line, a distance of 1.737 meters (5.7 feet) to the point of beginning, containing 40.469 square meters (0.01) acres, more or less; situated in and being a part of the Southeast ¼ of Southwest ¼.
