GOED Ethanol Governor's Office of Economic Development Notice of Public Hearing to Adopt Rules A public hearing will be held in the Dolly-Reed Plaza, Large Conference Room, 711 East Wells Avenue, Pierre, South Dakota, on September 10, 2025, at 11:30 a.m. (Central), to consider the adoption and amendment of proposed Administrative Rules of South Dakota numbered §§ 31:02:01:01 through 31:02:01:12, inclusive. The effect of the rules will be to implement the ethanol E15 fuel tax refund program established by the Legislature during the 2024 legislative session (SB 78, now codified as SDCL 10-47B-192). The reason for adopting the proposed rules is to provide for an orderly process by which licensed fuel marketers may apply for and obtain E15 fuel tax refunds from the ethanol infrastructure incentive fund. Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail them to the Governor's Office of Economic Development, 711 East Wells Avenue, Pierre, South Dakota, 57501 or to jack.valentine@state.sd.us. The deadline to submit any such written comments for consideration by this agency is ten days after the date of the public hearing. After the written comment period, the Governor's Office of Economic Development will consider all written and oral comments it receives on the proposed rules. The Governor's Office of Economic Development may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
