Under and by virtue of an order of the Superior Court of Cumberland County, North Carolina, made and entered in the action entitled "COUNTY OF CUMBERLAND, a political subdivision of the State of North Carolina vs. TIMOTHY THAGGARD, all assignees, heirs at law, and devisees of TIMOTHY THAGGARD, deceased, together with all his/her creditors and Lienholders regardless of how or through whom they claim, and any and all persons claiming any interest in the estate of TIMOTHY THAGGARD, deceased, Owner(s)", the Commissioner will at 12:00 noon, on the 01/13/2026, offer for sale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in Cumberland County, North Carolina, in Fayetteville, the following described real property, lying and being in Township, State and County aforesaid, and more particularly described as follows:
Beginning at a point in the northeastern margin of North Carolina Highway Number 53, the southeast corner of the two acres tract of land described in the deed dated January 9, 1946 from Major Melvin and wife, Roseana Melvin, to Rosie Melvin Johnson and husband, Herman Johnson, recorded in Book 485, Page 211, Cumberland County Registry, and running thence with the southern line of said two acres tract, North 51 degrees 15 minutes East 6.50 chains to a stake; thence South 67 degrees 30 minutes East 1.46 chains to a point in Downing's line; thence with it South 24 degrees 30 minutes West 4.20 chains to Gardner's corner; thence with Gardner's line North 76 degrees 30 minutes West 1.79 chains to a stake; thence with another line of Garder South 57 degrees 00 minutes West 2.56 chains to a point in the northeastern margin of said North Carolina Highway Number 53; thence with it North 26 degrees 15 minutes West 1.50 chains to the beginning, containing 1.50 acres, more or less.
And being the same land described in a deed dated May 6, 1976, from Josie Herring and husband Roscoe Herring to Timothy Thaggard, recorded in Book 2544, Page 261, Cumberland County Registry.
Subject to the Boundary Line Agreement recorded in Book 2600, Page 0423. Subject to the Right of Way Agreement recorded in Book 2700, Page 0715.
Subject to restrictive covenants, easements, rights-of-way, restrictions, and other conditions which appear of record in the Cumberland County Registry PIN No.: 0473-55-4832
This conveyance is made subject to restrictive covenants, easements, and right-of-way of record.
The said property is being sold as is, with all existing conditions or faults. The last and highest bid will be accepted and will be final and irrevocable and may not be withdrawn and shall not be refunded after the sale. The last and highest bidder shall be responsible for making any investigation deemed appropriate prior to sale as to the condition of the property, the state of title to the property, or any other matter affecting the property.
The sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause. This sale will not convey any personal property that may be located on the real property and the Commissioner makes no warranties or representations as to whether improvements to real property are real or personal in nature. A deposit of 20% or $750.00 whichever is greater in cash or certified funds of the successful bid will be required.
