Under and by virtue of an order of the Superior Court of Cumberland County, North Carolina, made and entered in the action entitled "COUNTY OF CUMBERLAND, a political subdivision of the State of North Carolina vs. JACK WARFLE, all assignees, heirs at law, and devisees of JACK WARFLE, deceased, together with all his/her creditors and Lienholders regardless of how or through whom they claim, and any and all persons claiming any interest in the estate of JACK WARFLE, deceased, Owner(s)", the Commissioner will at 12:00 noon, on the 02/05/2026, offer for sale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in Cumberland County, North Carolina, in Fayetteville, the following described real property, lying and being in Township, State and County aforesaid, and more particularly described as follows:
TRACT 1 (Bill# 450022)
Being all of Lot 22, Kelly's Landing, according to a plat of same duly recorded in Book of Plats 59, Page 96, Cumberland County Registry.
TRACT 2 (Bill# 450024)
Beginning at an iron stake in the centerline of a 60 foot road, said iron stake being located North 01 degrees 34 minutes 51 seconds East 254.15 feet and South 78 degrees 20 minutes West 13.31 feet from the Northeast corner of Lot #17 as shown on map entitled "Kelly's Landing, Section 2", as recorded in Plat Book 59, Page 96, Cumberland County Registry and running thence South 78 degrees 20 minutes West 13.32 feet to an iron stake; thence North 11 degrees 40 minutes West about 230.0 feet to a point on the bank of the Cape Fear River; thence with the bank of the Cape Fear River in an easterly direction about 176.1 feet to a point; thence South 23 degrees 37 minutes 02 seconds West about 281.7 feet to the Beginning, and containing 0.5 acres, more or less, being a portion of Lot 21, Kelly's Landing, according to a plat of same duly recorded in Book of Plats 63, Page 8, Cumberland County Registry and being a portion of the land conveyed to Rufus S. Jonson as recorded in Deed Book 2704, Page 837, Cumberland County Registry.

This conveyance is made subject to restrictive covenants, easements, and right-of-way of record.
The said property is being sold as is, with all existing conditions or faults. The last and highest bid will be accepted and will be final and irrevocable and may not be withdrawn and shall not be refunded after the sale. The last and highest bidder shall be responsible for making any investigation deemed appropriate prior to sale as to the condition of the property, the state of title to the property, or any other matter affecting the property.
The sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause. This sale will not convey any personal property that may be located on the real property and the Commissioner makes no warranties or representations as to whether improvements to real property are real or personal in nature. A deposit of 20% or $750.00 whichever is greater in cash or certified funds of the successful bid will be required.
