Petitioner seeks relief from the annual source test permit conditions for four internal combustion engines (permits 14976A, GNR-0017570, GNR-0017042, and GNR-0017043) and the annual source test requirement in Title 17 CCR § 95463(b)(4) for calendar year 2025 and 2026. A series of issues arose in July 2025 that made source testing and normal operation of the four engines not possible in calendar year 2025. As a result of the recent inability to produce power for five months in 2025, ReGen has incurred unbudgeted expenses and lost revenue. These fiscal impacts have reduced the available capital in calendar year 2026 and may affect investment decisions related to the engines, such as maintenance, and power infrastructure. Petitioner will limit engine run time in calendar year 2026 and if an engine is returned to operational status, it will be tested within 60 days.
