Under and by virtue of the power of sale contained in a certain Deed of Trust made by Dana Holman (deceased) and Priscilla W. Holman (deceased) (PRESENT RECORD OWNER(S): Priscilla W. Holman) to H. Terry Hutchens, Trustee(s), dated July 19, 2005, and recorded in Book No. 4144, at Page 1962 and re-recorded in Book No. 4196, at Page 2160 in Gaston County Registry, North Carolina. The Deed of Trust was modified by the following:
A Loan Modification recorded on April 24, 2015, in Book No. 4780, at Page 1647
, default having been made in the payment of the promissory note secured by the said Deed of Trust and the undersigned, Substitute Trustee Services, Inc. having been substituted as Trustee in said Deed of Trust by an instrument duly recorded in the Office of the Register of Deeds Gaston County, North Carolina and the holder of the note evidencing said indebtedness having directed that the Deed of Trust be foreclosed, the undersigned Substitute Trustee will offer for sale at the courthouse door in Gastonia, Gaston County, North Carolina, or the customary location designated for foreclosure sales, at 1:15 PM on March 18, 2026 and will sell to the highest bidder for cash the following real estate situated in Kings Mountain in the County of Gaston, North Carolina, and being more particularly described as follows:
TRACT I:
Beginning at an iron pin in Phillip Scott Williams' line (Deed Book 1464 at Page 305), in the southern margin of a 15 foot right of way, said iron being South 22 degrees 10 minutes 34 seconds East 17.24 feet from an existing iron pin, Phillip Scott Williams' northwest corner in Mary E. Brady's line (Deed Book 800 at Page 111); and runs thence with Williams' line South 22 degrees 10 minutes 34 seconds East 96.76 feet to an iron pin; thence continuing with Williams' line South 14 degrees 42 minutes 06 seconds West 233.32 feet to an iron pin, Williams' corner in Minnie W. Morrow's line (Deed Book 1014 at Page 456); thence with Morrow's line South 75 degrees 33 minutes 07 seconds West 51.05 feet to an iron pin, the southeast corner of a tract this day conveyed by Gerald J. Williams; thence with the eastern line of the said tract North 06 degrees 43 minutes 49 seconds East 220.06 feet to an existing iron pin; thence North 85 degrees 28 minutes 48 seconds West 33.00 feet to an iron pin in Gerald J. Williams' tract (Deed Book 1748 at Page 263); thence a new line through Everett P. Williams' tract North 18 degrees 58 minutes 54 seconds East 118.59 feet to an iron pin in the southern margin of a 15 foot easement granted by Everett P. Williams to Scott Williams; thence with the southern margin of the said 15 foot easement South 82 degrees 37 minutes 54 seconds East 41.00 feet to an iron pin, the point of beginning, containing 0.512 acres, more or less, according to an unrecorded Plat of Survey by David C. Caldwell, Registered Land Surveyor dated October 2, 1985, for Dana A. and Priscilla A. Holman.
Along with a perpetual 15 foot right of way for ingress and egress, said right of way to be appurtenant to the above described tract of land, leading from North Carolina Highway 161 to a tract of land owned by Phillip Scott Williams (Deed Book 1464 at Page 305). The northern line of a 15 foot right of way shall be the northernmost line of property owned by Everett P. Williams (Deed Book 716 at Page 23).
TRACT II:
Beginning at an iron pin in Minnie W. Morrow's line (Deed Book 1014 at Page 456), said iron being North 75 degrees 33 minutes 07 seconds East 218.39 feet from an iron pin, the common corner of Morrow and Gerald J. Williams on the eastern margin of the right of way for North Carolina Highway 161 and runs thence a new line through Gerald J. Williams' tract North 06 degrees 23 minutes 33 seconds East 226.51 feet to an iron pin; thence with Williams' line South 85 degrees 28 minutes 48 seconds East 20.0 feet to an iron pin, the corner of a tract this day conveyed by Everett P. Williams to Priscilla Holman; thence with the line of said tract South 6 degrees 43 minutes 49 seconds West 220.06 feet to an existing iron pin, Gerald J. Williams' southeast corner on Minnie W. Morrow's line; thence with Minnie W. Morrow's line South 75 degrees 33 minutes 07 seconds West 20.0 feet to an iron pin, the POINT OF BEGINNING, containing 0.099 acres, more or less, according to an unrecorded plat of survey by David C. Caldwell, Registered Land Surveyor dated October 2, 1985, for Dana A. and Priscilla A. Holman.
Together with improvements located thereon; said property being located at 1615 York Road, Kings Mountain, North Carolina.
Being the same property conveyed to Priscilla W. Holman, by General Warranty Deed dated October 10, 1985, from Everett P. Williams and wife, Bertha Williams, recorded October 18, 1985 in Book 1753 Page 463, Office of the Gaston County Register of Deeds. Also being the same property conveyed to Priscilla W. Holman, by General Warranty Deed dated October 10, 1985, from Gerald J. Williams and wife, Patsy Williams, recorded October 18, 1985 in Book 1753 Page 464, Office of the Gaston County Register of Deeds.
Trustee may, in the Trustee's sole discretion, delay the sale for up to three hours as provided in N.C.G.S. §45-21.23.
Should the property be purchased by a third party, that party must pay the excise tax, as well as the court costs of Forty-Five Cents ($0.45) per One Hundred Dollars ($100.00) required by N.C.G.S. §7A-308(a)(1).
The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance "AS IS, WHERE IS." Neither the Trustee nor the holder of the note secured by the deed of trust/security agreement, or both, being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representative of either the Trustee or the holder of the note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition are expressly disclaimed. Also, this property is being sold subject to all taxes, special assessments, and prior liens or prior encumbrances of record and any recorded releases. Said property is also being sold subject to applicable Federal and State laws.
A deposit of five percent (5%) of the purchase price, or seven hundred fifty dollars ($750.00), whichever is greater, is required and must be tendered in the form of certified funds at the time of the sale.
If the trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the confirmation of the sale and reinstatement of the loan without the knowledge of the trustee. If the validity of the sale is challenged by any party, the trustee, in its sole discretion, if it believes the challenge to have merit, may request the court to declare the sale to be void and return the deposit. The purchaser will have no further remedy.
Additional Notice for Residential Property with Less than 15 rental units, including Single-Family Residential Real Property
An order for possession of the property may be issued pursuant to N.C.G.S. § 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold.
Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may after receiving the notice of foreclosure sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days but not more than 90 days, after the sale date contained in this notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.
