IMPROVEMENTS TO FIREMAN'S PARK

ADVERTISEMENT AND NOTICE TO BIDDERS
Notice is hereby given that sealed Bids will be received by the Borough of Keyport for: "IMPROVEMENTS TO FIREMAN'S PARK" CONTRACT NO. 115.KP00204.H01 and opened and read aloud at Borough Hall located at 70 West Front Street, Keyport, New Jersey, on FRIDAY, JUNE 5, 2026 at 10:00 AM. prevailing local time.
The project generally consists of the reconstruction of Fireman's Park to include approximately 400 linear feet of bulkhead replacement, concrete promenade construction, storm sewer improvements, reconstruction/elevation of a 150-space public parking lot, landscaping and lighting improvements, the reconstruction/elevation of approximately 500 linear feet of the adjacent roadway along American Legion Drive, and associated work. Bidders are advised that this project is funded jointly by the Borough of Keyport, NJDEP Green Acres, NJDCA Boardwalk Preservation Fund, and a FEMA Pre-Disaster Mitigation Grant. Please be advised that State funds through the Green Acres Program are being utilized in this project. Under N.J.A.C. 7:1D-2, vendors currently suspended, debarred, or disqualified are excluded from participation in this project.
Plans, Specifications and Proposal Sheets may be obtained during normal business hours at the Office of Trevor J. Taylor, P.E., CME Associates, 3600 Route 66, 3rd Floor, Neptune, New Jersey 07753 until 48 hours prior to the time set for the opening of bids upon payment of $100.00 per set. No refunds will be made. The said Contract Documents and Proposal sheets may be examined at the Borough of Keyport, Administration Office, 70 West Front Street, Keyport, New Jersey.
Bids must be furnished on the proposal sheets included in the Contract Documents, enclosed in a sealed envelope and addressed to the Borough Clerk, Borough of Keyport, New Jersey and plainly marked on the outside with the name and address of the bidder and the Contract Number and Title.
Each bid must be accompanied by a certified check of (10%) percent of the bid, but not less than $20,000.00, payable without any conditional endorsement as a guarantee that in case the contract is awarded to the bidder, he will within ten (10) days thereafter execute such contract and furnish satisfactory performance bond. Upon failure to do so, he shall forfeit the bid security as liquidated damages and the acceptance of the bid will be contingent upon the fulfillment of this requirement by the bidder. No interest shall be allowed upon any such certified check. A bid bond in the amount of ten (10%) percent of the bid may be substituted for certified check, except the amount of the bid security shall not be less than $500.00 - nor more than $20,000.00. Each bid must be accompanied by a Certificate of Experience and Certificate of Equipment.
Each bid must also be accompanied by a certificate of Consent of Surety from a bonding company licensed to do business in the State of New Jersey guaranteeing that if the proposal of the bidder be accepted they will furnish the bond set forth in the Instructions to Bidders and the acceptance of the bid will be contingent upon the fulfillment of this requirement.
Evaluation and award of the bid shall involve a thorough review of the Contractor's technical capability, corporate experience, quality, past performance, technical plans, schedules, other submittals, and bid prices. The Borough reserves the right to increase or decrease quantities specified in the manner designated in the Specifications. The Borough reserves the right to award this contract based on funds available.
Bidders are required to comply with the requirements of the Americans with Disabilities Act (N.J.S.A.10:5-31 et seq.) and Affirmative Action (N.J.A.C. 17:27) and with the disclosure provisions of N.J.S.A. 19:44A-20.13. The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964.
Pursuant to N.J.S.A. 34:11-56.51, Contractors must be registered with the New Jersey Department of Labor and Workforce Development, Division of Wage and Hour Compliance at the time of bid, if applicable.
Bidders are herein advised that project is being funded partially through Federal grants awarded by FEMA. The Bidder shall be required to comply with Davis Bacon and Related Acts with respect to minimum wage rates. The successful Bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq. Minimum wage rates for this project shall be as specified in the "Prevailing Wage Determination of the New Jersey Department of Labor and Workforce Development" on file with this Department. General wage determinations issued under Davis-Bacon and related acts, published by US Department of Labor, may be obtained from the Wage Determinations online web site at: http://www.wdol.gov/dba.aspx.
As a result of the partial Federal funding involved with the project, Bidders and their subcontractors must also be able to provide a Unique Entity ID ("UEI") from www.sam.gov (the System of Award Management) and must maintain an active SAM registration through Final Completion of the Project. Please consult SAM.gov for more information or if you have questions about obtaining a UEI.
Bidders shall comply with N.J.S.A. 52:32-44 latest revision, regarding Business Registration with the New Jersey Division of Revenue.
During the performance of this contract the Contractor agrees to comply with the requirements of P.L. 1975, c. 127 (N.J.A.C. 17:27), all requirements of the State of New Jersey Worker Health and Safety Act (N.J.A.C. 12:110 et seq.) as amended and the United States Occupational Safety and Health Act (OSHA) (29 CFR 1910), as amended with regard to worker and jobsite safety.
No bidder may withdraw his bid for a period of sixty (60) days after the date set for the opening thereof. The successful bidder will be required to furnish a surety company bond in the full amount of the contract price indemnifying the Borough of Keyport, New Jersey for all proceedings, suits or actions of any kind of description and conditional for the faithful performance of the work.
The Borough Council reserves the right to reject any or all bids to the extent permitted by law (in accordance with N.J.S.A. 40A: 11-13.2 and applicable case law). An award will be made or bids will be rejected within sixty (60) calendar days after opening, unless Mayor and Council extend the award period.
