Probate No.: 20211714; Parish of Ouachita, State of Louisiana, Fourth Judicial District Court Notice is hereby given that Petitioners and duly appointed Executors, Dr. Nick Bruno and Harvey R. Little, Sr., have applied for authority from this Court, by Petition filed on May 05, 2026, in the above Succession of John H. McCarter, Jr., seeking authority from the Fourth Judicial District Court to sell the following immovable properties at private sale: 326 Bayou Bank Road, Monroe, Ouachita Parish, Louisiana, hereinafter described, to-wit: A certain lot or parcel of land situated in the South Half (S ½) of Section 4, township 18 North, Range 4 East, Ouachita Parish, Louisiana, being more particularly described as follows, to-wit: From an iron pin at the intersection of the South line of Lot Eight (8) of Delery's Island Colony Subdivision as per plat thereof in Conveyance Book "T", page 332, records of Ouachita Parish, Louisiana, and the East boundary of the right of way of Old Sterlington Road (formerly State Route 200), run North 89 degrees, 58 minutes East along said south line of said Lot Eight (8) as distance of 1,553.32 feet to an iron pin set the average water level of Bayou Desiard, and the Point of Beginning: thence run South 89 degrees, 58 minutes West along said South line of said Lot Eight (8) a distance of 628.66 feet to an iron pin at the Northeast corner of that certain tract of parcel of land conveyed by Mrs. Adrienne M. Gaston, et al to Robert Waldrop Ellington, Jr. by Deed recorded in Conveyance Book 1070, page 809, records of Ouachita Parish, Louisiana; thence run South 00 degrees, 02 minutes East along the line of said Ellington property a distance of 182.65 feet: thence run North 89 degrees, 58 minutes East along the line said Ellington property a distance of 250 feet; thence run South 380 feet to an iron pin at the Southeast corner of said Ellington property, thence run South 380 feet to an iron pin at the Southeast corner of said Ellington property, thence run North 89 degrees, 58 minutes East a distance of 721.95 feet, more or less, to a point at the average water level of Bayou Desiard; thence run Northwesterly along the average water level of Bayou Desiard to the Point of Beginning: TOGETHER WITH any and all riparian rights and property susceptible to private ownership which lies between the North and South lines of the herein described property, extended Easterly to the center of Bayou Desiard; AND TOGETHER WITH that certain right-of-way of right of passage 14 feets in width located across the Northerly 14 feet of the Ellington property as identified herein, extending from the West line of the property described herein, retained and established by Mrs. Adrienne M. Gaston et al in the referenced Act of Sale to Robert Waldrop Ellington, Jr. recorded in Conveyance book 1070, page 809. Records of Ouachita Parish, Louisiana: AND TOGETHER WITH that certain right-of-way of right of passage 14 feet in width located across the Northerly 14 feet of that certain tract or parcel of land conveyed by Nathan G. Gaston to Larry M. Bennett by deed recorded in Conveyance Book 890, page 698, records of Ouachita Parish, Louisiana, said right-of-way extending Easterly from the Old Sterlington Road to the property conveyed to Robert Waldrop Ellington, Jr. as identified above, subject, however, to the right-of-way of the A&LM Railroad, said right-of-way having been reserved by Nathan G. Gaston, for the benefit of himself, his heirs, successor and assigns as a right of passage for ingress and egress form the public road, in the referenced Act of Sale to Larry M. Bennett recorded in Conveyance Book 890, page 698, records of Ouachita Parish, Louisiana: The property described herein consisting of all the property recognized as owned by Adrienne M. Gaston and Adrienne Gaston Smith as widow and sole heir of Nathan G. Gaston, respectively, in the Judgment of Possession rendered in the Succession of Nathan G. Gaston recorded in Conveyance Book 996, page 244 records of Ouachita Parish, Louisiana, which lies between the right-of-way of the A&LM Railroad on the West and Bayou Desiard on the East less and except that portion conveyed to Robert Waldrop Ellington, Jr., as identified herein, together with a right of passage for ingress and egress, 14 feet in width, extending from the Old Sterlington Road, Easterly to the property as particularly described herein. For the sales price of $476,000.00, and otherwise according to the terms and conditions set forth in the Purchase and Sales Agreement filed in the record of this matter. Two publications of this "Legal Notice" are required by law. Any person who opposes the sale of the properties, under the terms specified, must file notice of their objection and the basis thereof with the Court within seven (7) days of the date of the second (last) publication of this Legal Notice, or prior to the signing of an order by the Court authorizing same.
