ORDER FOR SERVICE BY PUBLICATION
WHEREAS, it appearing from the Verified Petition to Quiet Title that there are no interested parties in the two (2) parcels identified as: TPN: 06-115.00-263 ("Parcel 1") and TPN: 06-115.00-262 ("Parcel 2", together with Parcel 1, the "Properties"); WHEREAS, the hearing has been scheduled for the routine hearing date of September 1, 2026 at 10:00 a.m. in Kent County, Delaware at the Court of Chancery located at 414 Federal Street, Dover, DE 19901; IT IS HEREBY ORDERED, this day 25th day of June 2026, that any and all persons or entities that claim a legal or equitable interest in the Properties, and who wish to assert any claim or interest that they rightfully have in defense of the action, shall file an answer or other pleadings with the Register in Chancery at the Kent County Courthouse located at located at 414 Federal Street, Dover, DE 19901, on or before the 1st day of September 2026, at 10:00 a.m. to show cause, if any there be, why the relief requested by the Petitioners in the pleadings should not be granted. Failure to file papers in response to the Verified Petition with the Register in Chancery will result in the entry of judgment declaring, among other things, that: (1) the Restriction reserved in favor of Beneficial Building Corporation as contained in the deed recorded February 28, 1986, in the Office of the Recorder of Deeds in and for New Castle County in Deed Book 344, page 328, as amended, is no longer enforceable and is hereby extinguished and removed as an encumbrance on the Properties, and (2) Petitioners are seised of; and entitled to exclusive, quiet and peaceful possession of and has fee simple absolute title to the entire fee interest in the land that comprises the Properties, free and clear of the Restriction whereby no person other than Petitioners, may state any estate, right, title, lien or interest, equitable legal or otherwise, in or to the Properties or any part thereof: FURTHERMORE, the Petitioners' Attorney is hereby directed to cause a copy of this Order to be published in The News Journal, a newspaper of general circulation in and throughout the State of Delaware, once a week for three consecutive weeks. Petitioners' Attorney is hereby directed to post on property and file affidavit of posting.
