TO THE ABOVE-NAMED DEFENDANTS:
You are notified that a petition has been filed in the office of the clerk of this court naming you as a defendant in this action, which petition elects to foreclose with redemption and prays for judgment against the real estate locally known as 8601 EP Westown Parkway #23103, West Des Moines, Iowa 50266 in an amount which represents the unpaid principal balance of monthly association dues, plus interest per annum from January 31, 2021, and the costs of this action. Petition further prays that Plaintiff's lien be foreclosed; with the exception of Leighton State Bank, Ervin L. Fopma and Gaule I. Fopma as trustees of the Fopma Ventures Trust, that any right, title, lien, or interest of Defendants or any of them in said property be declared junior and inferior to the lien of Plaintiff's; that a special execution issue for the sale of the premises or so much thereof as may be necessary to satisfy the judgment including interest, costs, and accruing costs, including, but not limited to, any and all advances made by Plaintiff for taxes, insurance, property preservation, and other costs between the time of the foreclosure decree and the time of sheriff's sale, and that from and after said sale under special execution, the right, title, lien, or interest of Defendants in and to the premises be forever cut off, barred, and foreclosed. Plaintiff further prays that a certificate of purchase be issued immediately to the purchaser at said sale, and if Defendant Wyjna does not redeem within the one-year redemption period, then the certificate holder may surrender the certificate of purchase and the Sheriff of Dallas County will issue a sheriff's deed; and that upon issuance of the sheriff's deed a writ of possession shall be issued under the seal of the Court directed to the Sheriff of Dallas County, Iowa, commanding him to put the purchaser at said sale or his successor-in-interest into immediate possession of the premises. Plaintiff further prays that if the proceeds from the sheriff's sale are insufficient to satisfy the judgment rendered in favor of Plaintiff, that general execution issue against Defendant Wynja for the deficiency of the judgment rendered in favor of Plaintiff.
