In accordance with M.G.L. c. 149, 44D 1/2 and 44D 3/4, and 810 CMR 9.00 and 10.00, the Town of Eastham has established a two-phase process for the selection of General Contractors and filed sub-bid Subcontractors for the construction of the Eastham Wastewater Treatment Facility for the Town of Eastham, MA. With the exception of the Tile subcontractor category, only contractors/subcontractors prequalified to bid on the above referenced project shall be invited to submit bids and/or sub-bids as part of Phase 2 of the selection process. The Tile subcontractor category was solicited twice and received two responses; therefore, this category will be open to all firms meeting the requirements of this work category.
General Contractor sealed bids will be received by the Town Manager's Office at the Eastham Town Hall, 2500 State Highway, Eastham, Massachusetts until 2:00 p.m. local time on April 30, 2026, and at that place and time will be publicly opened and read aloud. All bids will be valid only when accompanied by a current certificate of eligibility and updated statement (Form CQ3) issued by the Division of Capital Asset Management and Maintenance (DCAMM), showing that the General Bidder has the classification of Sewage and Water Treatment Plants.
Filed subcontractor sealed bids designated herein for construction of the above referenced project will be received by the Town Manager's Office at the Eastham Town Hall, 2500 State Highway, Eastham, Massachusetts until 2:00 p.m. local time on April 16, 2026, and at that place and time will be publicly opened and read aloud. All bids will be valid only when accompanied by a current certificate of eligibility and updated statement issued by the Division of Capital Asset Management and Maintenance (DCAMM), showing that the Filed Sub Bidders have the classification matching the Filed Sub-Bid being submitted.
The Project is being bid under the provisions of M.G.L. c.149, s44D. Bidding and award of this Contract shall be required to comply with Massachusetts General Law Chapter 149, Section 44A-44J, and all other applicable Massachusetts General Laws.
Separate sealed Bids will be received for the following: General Construction – Sewage and Water Treatment Plants; Masonry; Miscellaneous and Ornamental Iron; Roofing and Flashing; Waterproofing, Dampproofing, and Caulking; Metal Windows; Acoustical Tile; Resilient Flooring; Painting; Fire Suppression; Plumbing; Heating, Ventilating, and Air Conditioning; Electrical and Instrumentation; Tile.
The Work consists of the construction of a new wastewater treatment facility including site work, buildings, concrete structures, process mechanical equipment, associated electrical equipment, underground piping, and open sand beds. In accordance with the Bidding Documents heretofore prepared by GHD Inc. 970 calendar days will be allowed for contractor to achieve substantial completion and 1030 calendar days to achieve final completion.

Copies of Bidding Documents may be purchased at the office of GHD, 1545 Iyannough Road, Hyannis, MA 02601 after 12:00 noon on March 18, 2026. Procurement Considerations - Six Good Faith Efforts. 40 CFR, Part 33, Subpart C: Pursuant to 40 CFR Section 33.301, the sub-recipient agrees to make good faith efforts whenever procuring construction, equipment, services, and supplies under an EPA financial assistance agreement, and to require that sub-recipients, loan recipients, and prime contractors also comply.
Minimum Wage Rates as determined by the Executive Office of Labor and Workforce Development under the provision of the Massachusetts General Laws, Chapter 149, Sections 26 to 27D, as amended, apply to this project. It is the responsibility of the contractor, before bid opening, to request, if necessary, any additional information on Minimum Wage Rates for those trades people who may be employed for the proposed work under this contract. Federal Minimum Wage Rates as determined by the United States Department of Labor under the Davis-Bacon Act also apply to this project.
The Town of Eastham reserves the right to waive any informalities or to reject any or all Bids.
Bidders are required to certify, under penalty of perjury, that Bids have been prepared without collusion with other Bidders, subcontractors, suppliers, etc. This certification is included with the Bid Form and each Bidder must sign in the space provided.
The Project is to be funded in part by the Massachusetts Clean Water Trust (the "Trust").
The Project is funded by appropriations that contain "Build America, Buy America Act" (BABA) requirements.
The Project is subject to the American Iron and Steel requirements of P.L. 113-76, the Consolidated Appropriations Act of 2014.
The Project requires compliance with the Department of Environmental Protection's Diesel Retrofit Program.
A non-mandatory Pre-Bid Conference for Contract 1 will be held at 10:00 a.m. on April 7, 2026 at Eastham Town Hall, 2500 State Highway, Eastham, Massachusetts. Representatives of Owner and Engineer will be present to discuss the Project. Bidders are encouraged to attend and participate in the conference.
