The Salmon Law Firm, PLLC 179 Wallins Corners Road, Amsterdam, New York 12010 (518)842-1650 diane@thesalmonlawfirm.com LAST WILL AND TESTAMENT I, EUGENE YANAS, of the Town of Root, in the County of Montgomery and State of New York, being of sould mind and memory, do make, publish and declare this my last Will and Testament, in the manner following, that is to say: FIRST: I direct the payment of all my just debts, funeral expenses and expenses of administration of my estate, together with any estate or inheritance taxes thereon, which my be assessed or charged against my gross estate or any portion thereof, including any non probate assets, and any other estate expenses, same to be paid from my residuary estate and not charged against any legacies which may hereafter be provided. SECOND: All the rest, residue and remainder of my estate, real, personal and mixed and wheresoever situate, I give, devise and bequeath to my friend NANCY BELL, absolutely and forever. In the event that my said friend should predecease me or we should die in a common disaster making it uncertain which death occurred first, then and in that event, I give, devise and bequeath said residue of my estate to my niece, Diana Dudley and my nephews, John Paul Yanas and Nicholas Yanas, Jr., as are surviving at the time of my death, equally, share and share alike. In the event any of my said niece or nephews should predecease me or we should die in a common disaster making it uncertain which death occurred first, then and in that event, I give, devise and bequeath the share of the one so dying to such of my niece and nephews as are survivng, equally share and share alike, absolutely and forever. LASTLY: I hereby appoint my friend NANCY BELL, Executrix of this my Last Will and Testament. I hereby revoke all former wills by me made and grant my Executrix full power and authority to sell and convey, lease or mortgage real estate. In the event of my said friend should predecease me, fail to qualify or fail to complete the administration of my estate, then I appoint my niece, Diana Dudley, as Executrix in her place and stead. I hereby waive the requirement of any bond or other security by either of said named executrices.
