Please take notice that the US Navy, Portsmouth Naval Shipyard, PWD-Maine Environmental, Bldg 59/2, Portsmouth NH 03804-5000 (Contact Portsmouth Naval Shipyard Public Affairs Office (PAO) at 207-438-1525) is intending to file a Coastal Consistency Determination, a Waste Discharge License (WDL)/Maine Pollutant Discharge Elimination System (MEPDES), Minor Revision under the Site Location of Development Act and Natural Resources Protection Act Permit-By-Rule for informational purposes with the Maine Department of Environmental Protection pursuant to the provisions of 38 M.R.S.A. §§ 481-490 and a Natural Resources Protection Act Permit Application pursuant to the provisions of 38 M.R.S.A. §§ 480-A through 480-BB on or about September 8th, 2025.
The application is for the P-1112 Building 72 Resiliency Improvements Project at Berth 4 and Berth 5 at the Portsmouth Naval Shipyard (PNSY) in Kittery, Maine. The project would include construction and operation of a desalination facility to support the process water demands of PNSY at Berth 5 on Seavey Island in the Piscataqua River. The purpose of the project would increase the resiliency of PNSY, and conserve potable drinking water (no longer used for industrial processes).
The operations would result in an intake of approximate 1.12 million gallons per day (MGD) and both continuous and intermittent discharges to the Piscataqua River approx. 0.78 MGD. The installation of a desalination facility would save an average of approximately 400,000 gallons of potable water per day.
A request for a public hearing or a request that the Board of Environmental Protection assume jurisdiction over this application must be received by the Department, in writing, no later than 20 days after the application is found by the Department to be complete and is accepted for processing. A public hearing may or may not be held at the discretion of the Commissioner or Board of Environmental Protection. Public comment on the application will be accepted throughout the processing of the application.
For Federally licensed, permitted, or funded activities in the Coastal Zone, review of this application shall also constitute the State's consistency review in accordance with the Maine Coastal Program pursuant to Section 307 of the federal Coastal Zone Management Act, 16 U.S.C. §1456.
The application will be filed for public inspection at the Department of Environmental Protection's office in Portland during normal working hours. A copy of the application may also be seen at the municipal offices in Kittery, Maine.
