A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On March 18, 2026, Constellation Framingham, LLC. Recorded with the Middlesex South Registry of Deeds a Notice of Activity and Use Limitation on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The NOTICE OF ACTIVITY AND USE LIMITATION will limit the following site activities and uses on the above property: (i) Modification of existing structure(s) or construction of new structure(s) designed for human occupation without a vapor intrusion assessment to be conducted by a Licensed Site Professional and implementation of measures, if needed, to ensure that a condition of No Significant Risk is maintained; (ii) Modification or removal of soil between grade and eight feet below surface grade within the AUL area that would cause a change in exposure potential to the occupants of the property without prior consultation with a Licensed Site Professional and development of appropriate control mechanisms; (iii) Residences or other uses involving permanent occupancy thereof; (iv) Schools, as defined by 310 CMR 40.0006, which include day care centers, kindergarten, or similar uses; and, (v) Gardening or other agricultural uses which utilize these soils for the cultivation of edible plants destined for human consumption.
