PLEASE TAKE NOTICE that the Board of Trustees of the Village of Cold Spring, New York, will hold a public hearing pursuant to amending the Village of Cold Spring Village Code by inserting a new Chapter known as "Chapter 125," which new Chapter is entitled "Village Justice Court," and containing the text below, at Village Hall, 85 Main Street, Cold Spring, New York 10516, on the 14th day of January 2026, at 7:00 PM, or as soon thereafter as the matter may be heard. § 125-1. Findings, Legislative Intent
New York State Village Law §3-301.2(a) permits a village, by the adoption of a local law, subject to a permissive referendum, to establish the position of an associate justice or otherwise called the Acting Village Justice (hereinafter the "Associate Village Justice") who shall serve when requested by the Village Justice or in the absence or inability of the Village Justice to serve. The Village Board of Trustees determines that it is in the best interest of the Village and its residents to ensure that the Village Justice Court has a qualified Associate Village Justice in the event the Village Justice is absent or unable to serve so that the Village Court will be able to function and operate continuously.
New York State Village Law §3-300.2(b) permits the Village Board of Trustees of a village with a population of less than 3,000 to provide, in lieu of any other residency requirements imposed by the law, that the Village Justice and/or Associate Justice may reside within a county in which the village is wholly or partially situated. The Village Board of Trustees determines that it is in the best interest of the Village and its residents to ensure that the Village Justice Court has a qualified Associate Village Justice in the event the Village Justice is absent or unable to serve so that the Village Court will be able to function and operate continuously. The Village is situated in Putnam County and has a population of approximately 2,000 people.
The Village Board of Trustees determines that it is in the best interest of the Village and its residents to ensure that the Village Justice Court has a qualified Court Clerk, who need not reside in the Village or Putnam County.
§ 125-2. Establishment of Associate Village Justice
In accordance with New York State Village Law §3-301.2(a), the Village of Cold Spring shall have an Associate Village Justice, who shall serve in the event the Village Justice is absent or unable to serve. The Associate Village Justice shall be appointed by the Village Mayor, subject to the approval of the Village Board of Trustees. The term of the Associate Village Justice shall be one (1) year, or the remaining portion thereof.
§ 125-3. Village Justice, Associate Village Justice, and Court Clerk residency requirements
The Village of Cold Spring Village Justice shall be a resident of the Village of Cold Spring.
Notwithstanding the residency requirements of New York State Public Officers Law and the New York State Village Law, and in accordance with New York State Village Law Section 3-300.2(b), the Village of Cold Spring Associate Village Justice may reside within the Village of Cold Spring or the County of Putnam.
Notwithstanding the residency requirements contained in §3.8 of the New York State Public Officers Law that appear to apply to the Court Clerk, the Court Clerk may reside within the Village of Cold Spring or the County of Putnam or an adjoining County within New York State.
Section 3. Severability.
If any clause, sentence, paragraph, subdivision, section, or part of this Local Law or the application thereof to any person, individual, corporation, firm, partnership, entity, or circumstance shall be adjudged by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part of this chapter, or in its application to the person, individual, corporation, firm, partnership, entity, or circumstance directly involved in the controversy in which such order or judgment shall be rendered.
Section 4. Repeal.
All ordinances, local laws and parts thereof inconsistent with this Local Law are hereby repealed.
Section 5. Authority.
This Local Law is enacted pursuant to the Municipal Home Rule Law and New York State Village aw Section 3-300.2(b) and Section 3-301.2(a). This Local Law shall supersede the provisions of Public Officer's Law Village Law to the extent it is inconsistent with the same and to the extent permitted by the New York State Constitution, the Municipal Home Rule Law, or any other applicable statute.
Section 6. State Environmental Quality Review Act.
This Local Law is classified as a Type II Action under the regulations governing the State Environmental Quality Review Act.
Section 7. Effective date.
This Local Law shall take effect immediately upon filing it with the Office of the Secretary of State of the State of New York in accordance with Section 27 of Municipal Home Rule Law.
