LEGAL NOTICE NOTICE OF ACTIVITY AND USE LIMITATION 10 NEBRASKA STREET WORCESTER, MA MASSDEP RTN 2-19921, 2-20620 A release of oil and/or hazardous material has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, and the Massachusetts Contingency Plan, 310 CMR 40.0000. On July 23, 2025, ASAA, LLC recorded with the Worcester Registry of Deeds a NOTICE OF ACTIVITY AND USE LIMITATION (AUL) on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The NOTICE OF ACTIVITY AND USE LIMITATION will limit the following site activities and uses on the above property: (i) Use for single-family residential purposes; (ii) Use for agricultural purposes, where the subsurface soil is used for growing fruits or vegetables for human consumption, unless gardening is performed in raised beds; (iii) Use as a school, daycare, park, playground or schoolyard. (iv) Any excavation/disturbance of soil at the site with the exception of emergency utility repair as outlined in Paragraph 1 of the AUL, without prior development of a Soil Management Plan and a Health and Safety Plan in accordance with Paragraph 3 of the AUL unless a Licensed Site Professional renders and Opinion which states that such excavation/disturbance of soil is consistent with maintaining a condition of No Significant Risk.
