LEGAL NOTICE
Please take notice that NECG TOMS RIVER BH, LLC (the "Applicant") has applied to the Township of Toms River Planning Board ("Planning Board") for preliminary and final subdivision approval with variances in order to subdivide Block 647, Lot 26.01, Toms River, New Jersey (the "Property") into two lots (Proposed Lot A containing +/- 370,144 sq. ft. and Proposed Lot B containing +/- 65,570 sq. ft.) Applicant will also seek any and all required variances and waivers, as may be required upon review of the application by the Planning Board and its experts, including but not limited to the following variances:
1. Minimum corner lot frontage 150' required, 110' provided Proposed Lot A;
2. Minimum front yar setback 60' required, 59.3' provided Proposed Lot A; '
3. Minimum side yard setback 5' required, 0' provided Proposed Lot A;
4. Maximum building coverage 25% permitted, 27% provided Proposed Lot A;
5. Maximum impervious coverage 80% permitted, 91.3% provided Proposed Lot A and 83.50% provided Proposed Lot B;
6. Solid waste storage setback 10' required and 1.5' provided Proposed Lot B;
7. Parking required 415 spaces, 109 spaces provided on Proposed Lot B and 287 spaces are provided on Proposed Lot A. Proposed Lot B is directly accessed through Proposed Lot A. A Declaration of Easement is recorded against the Property that permits access for ingress, egress and parking within Block 647, Lot 8.01; and
8. 5' unbroken landscaping strip required along side and rear property line. None is proposed between Proposed Lots A and B.
A public hearing will be held before the Planning Board on June 3, 2026 at 6:00 p.m. as a caucus meeting with regular meeting/hearing items to immediately follow at the Toms River Municipal Complex, 33 Washington Street, Toms River, New Jersey 08753 to consider this application.
At said public hearing, any person interested in this matter will be given an opportunity to be heard either in person or by attorney.
The application, plans, and other documents regarding the application are on file in the Planning Board Office located in the Toms River Municipal Complex at 33 Washington Street, Toms River, New Jersey and can be examined during normal business hours, Monday through Friday, except on legal holidays.
