TOWN OF HAMILTON
The Town of Hamilton Zoning Board of Appeals will hold a Public Hearing on Tuesday, June 17, 2026, at 7:00 pm at the Town of Hamilton Community Room, located at 38 Milford Street, Hamilton, NY. The purpose of the hearing is to hear public comments on a variance application.
An application has been made for multiple area variances by Forward Sand and Gravel. They wish to operate a gravel mine located at 1861 NYS Route 12 in the Town of Hamilton, tax map # 170.-1-68 on a 81.7 acre property. They are seeking the following variances:
Relief from Town of Hamilton Zoning Law Sections 6.5.1-A:
4) The boundaries of the area of the site proposed for mining must be a minimum linear distance of 1000 feet from the closest residences, businesses, schools, and public gathering places.
The nearest residences to the mining area are located approximately 370 feet to the southwest and 600 feet to the south.
5) The boundaries of the area of the site proposed for mining must be set back a minimum linear distance of 1,000 feet from property lines, roads, rights-of-way., wetlands, and watercourses. Where a proposed mine is immediately adjacent to another operational mine or excavation use, the mining must be set back a minimum linear distance of 100 feet.
Property lines are 25 feet to the west and 300 feet to the southeast.
Ackley Road is 200 feet to the south, the ROW to NYS Route 12 is 300 feet away to the southeast. NYSDEC wetland IIB-11 is 100 feet away to the north- The Sangerfield River is approximately 300 feet away to the northwest.
6) All structures, parking areas, loading areas, and truck staging areas must be set back a minimum linear distance of 300 feet from property lines (unless the adjoining use is "Mining" or "Excavation" in which case the setback shall be 150 feet), roads, rights–of-way, wetlands, and watercourses.
Property lines are 25 feet to the west and 300 feet to the southeast. Ackley Road is 200 feet to the south, the ROW to NYS Route 12 is 300 feet away to the southeast. NYSDEC wetland HB-l I is 100 feet away to the north. The Sangerfield River is approximately 300 feet away to the northwest.
7) If the mining use proposes to include blasting or processing of materials, the areas where such activities will take place must be a minimum linear distance of 2,000 feet from property lines and off-site roads.
Property lines are 25 to the west, 300 feet to the southeast, 1,150 feet to the north, and 1,600 to the east-northeast.
