Legal Notice
Please take notice that Palisades Properties, LLC (the "Applicant") the lessee of property known as 5 Mulberry Trail, Kinnelon, New Jersey, and shown on the Tax Map as Block 45605, Lot 103 (the "Property"), has made application to the Borough of Kinnelon Zoning Board of Adjustment (the "Zoning Board") for a request for a reasonable accommodation/(d)(1) use variance to permit the operation of a sober living home that is licensed as a Cooperative Sober Living Residence ("CSLR") on the Property. This CSLR provides a home for up to seven (7) individuals to reside while they receive outpatient treatment for drug and alcohol addiction at a separate location. A live in house manager also resides at the Property to supervise the individuals. These individuals and the house manager are the "residents" of the CSLR.
Applicant has also requested an interpretation from the Board on whether Applicant's CSLR residents constitute a "family" under the Borough Code and applicable case law and that same may reside in a single-family residence in the Borough's Residential zone as a permitted use without the need for a use variance/reasonable accommodation. The Applicant also requests such additional variances, waivers, site plan waiver, or other relief required by the Zoning Board after its review of the application.
A public hearing is scheduled before the Zoning Board on Tuesday, June 9, 2026, at 7:00 p.m. in the Municipal Building, Council Chambers, 130 Kinnelon Road, Kinnelon, New Jersey. When the case is called, you may, either in person or by agent or attorney, appear and present any comments which you may have regarding this application.
