MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Richard A. Marsan and Nancy A. Marsan to Webster Five Cents Savings Bank dated September 19, 2019, and recorded with Worcester District Registry of Deeds in Book 61102 Page 203, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage for the purpose of foreclosing the same will be sold at Public Auction at eleven o'clock, (11:00 A.M.), on July 31, 2026, at the mortgaged premises located at 12 Pine Ridge Drive, Oxford, Massachusetts, as described below, being all the premises described in said mortgage,
To wit:
THE LAND IN OXFORD ON THE SOUTHERLY SIDE OF PINE RIDGE DRIVE, BOUNDED AND DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWESTERLY CORNER OF THE PREMISES HEREIN CONVEYED AT A POINT IN THE SOUTHERLY LINE OF SAID PINE RIDGE DRIVE, SAID POINT ALSO BEING THE NORTHEASTERLY CORNER OF LOT NO. 40 AS SHOWN ON A PLAN ENTITLED PINE RIDGE ESTATES, DRAWN BY CULLINAN ENGINEERING CO. INC DATED OCTOBER 16, 1968 AND RECORDED WITH THE WORCESTER DISTRICT REGISTRY OF DEEDS IN PLAN BOOK 326, PLAN 52;
THENCE S. 24° 34'01" W. ONE HUNDRED TWENTY-FIVE (125.0) FEET BY SAID LOT 40 TO A POINT AT LOT NO. 46 AS SHOWN ON SAID PLAN;
THENCE S. 80° 42' 09" E. ONE HUNDRED TWENTY-SIX AND 11/100 (126.11) FEET AND PARTLY BY LOT NO. 45 PARTLY BY LOT NO. 46 TO A POINT AT LOT NO. 42;
THENCE N. 13° 19' 14" E. ONE HUNDRED THREE AND 77/100 (103.77) FEET BY SAID LOT NO. 42 TO A POINT IN THE SOUTHERLY LINE OF PINE RIDGE DRIVE;
THENCE WESTERLY ALONG THE SOUTHERLY LINE OF PINE RIDGE DRIVE ONE HUNDRED TWO AND 07/100 (102.07) FEET TO THE POINT OF BEGINNING.
BEING LOT NO. 41 AS SHOWN ON THE PLAN ENTITLED PINE RIDGE ESTATES, DATED OCTOBER 16, 1968 AND RECORDED IN WORCESTER DISTRICT REGISTRY OF DEEDS IN PLAN BOOK 326, PLAN 52.
CONTAINING 12,700 SQUARE FEET MORE OR LESS.
SUBJECT TO RESTRICTIONS OF RECORD.
BEING THE SAME PREMISES CONVEYED TO RICHARD A. MARSAN AND NANCY A. MARSAN, HUSBAND AND WIFE, AS TENANTS BY THE ENTIRETY, BY DEED OF CHRIS-ROL CONSTRUCTION, INC., DATED NOVEMBER 22, 1974 AND RECORDED WITH WORCESTER DISTRICT REGISTRY OF DEEDS IN BOOK 5626, PAGE 107.
Said premises will be sold subject to all outstanding municipal or other public taxes, tax titles, assessments, liens or claims in the nature of liens, rights of tenants and parties in possession and existing encumbrances of record, if any, which take precedence over said mortgage above described. The mortgaged property will be sold subject to the right of redemption of the United States of America, if any there be. If the premises are not serviced by a public sewerage system, the purchaser will be solely responsible for compliance with all Title V regulations, including but not limited to, any inspection and upgrade requirements set forth in 310 CMR 15.300 through 15.305.
The highest bidder shall be required to pay $10,000.00 by bank or certified check at the time and place of the sale as a deposit, and the balance will be due in thirty (30) days at the office of the attorney for the Mortgagee. The purchaser will be responsible for all closing costs, state documentary stamps and recording fees. In the event that the successful bidder at auction fails to purchase the property in accordance with the Terms of the Sale and this notice, the mortgagee reserves the right to sell the premises by foreclosure deed to the second highest bidder at the time of the foreclosure sale. Said second bidder would then be required to execute a Memorandum of Terms and Conditions of Sale and provide the required deposit within five business days of receiving written notice of default of the previous highest bidder.
The Mortgagee reserves the right to postpone the auction to a later
date by public proclamation at the time and date of the auction.
Other terms are to be announced at the sale.
