MORTGAGEE'S NOTICE OF SALE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Della M. Rogowski to Financial Freedom Senior Funding Corporation dated February 26, 2009, filed with Norfolk Registry District of the Land Court as Document No. 1169406 and noted on Certificate of Title No. 101965, which mortgage was assigned to Mortgage Electronic Registration Systems, Inc. ("MERS") as Nominee for Financial Freedom Acquisition LLC by Assignment dated December 28, 2009, and filed as Document No. 1191777; further assigned to Secretary of Housing and Urban Development by Assignment dated April 8, 2016, filed as Document No. 1354934; and further assigned to Wilmington Savings Fund Society, FSB, as Owner Trustee of the Residential Credit Opportunities Trust X-A by Assignment dated January 21, 2025, filed as Document No. 1548549, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 AM, on the 6th day of January, 2026, at the mortgaged premises described and known as 13 Center Street, Medway, Massachusetts described in said mortgage, to wit: The Land with the buildings thereon situated in Medway, Norfolk County, MA, known and being numbered: 13 Center Street. The land in Medway, Norfolk County, Massachusetts, together with the buildings thereon, situated on the Westerly side of Centre Street, bounded and described as follows: Easterly by said Centre Street, 75.0 feet; Southerly by Lot No. 6 on a plan hereinafter referred to, 280.76 feet; Westerly by land now or formerly of John Rogers et al, 75.05 feet; and Northerly by Lot No. 4 on said Plan, 277.88 feet. All of said boundaries are determined by the Land Court to be located as shown on a Subdivision Plan as approved by the Court, entitled, "Plan of Land in Medway, MacCarthy Engineering Service, Inc., June 6, 1952, William F. Drake, CE, January 25, 1956" filed in the Land Registration Office as No. 25876A, a copy of a portion of which is filed in the Norfolk Registry District of the Land Court, Said lot is shown as Lot 5 on above mentioned plan , filed with Certificate 56188. Subject to a water extension agreement with the Town of Medway duly recorded with Norfolk District of the Land Court. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale date. The Mortgagee further reserves the right to open the bidding at the time, date and place appointed for sale, and if no bids are received, or the bids received are deemed unacceptable to Mortgagee, to postpone the sale to a later date by public proclamation. Said premises will be sold subject to and with the benefit of all restrictions, easements, improvements, outstanding tax titles, mortgages, liens, rights of tenants and parties in possession, unpaid taxes, municipal liens and other public taxes, assessments or liens, having priority over the mortgage described herein, if any. In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with Mortgagee's attorneys the amount of the required deposit as set forth herein within three (3) business days after written notice of default of the previous highest bidder and title shall be conveyed to said second highest bidder within twenty (20) days of said written notice.
TERMS OF SALE: Ten Thousand Dollars ($10,000.00) will be required to bid and be paid in cash or by certified check at the time and place of sale as earnest money. The balance is to be paid in cash or by certified check within thirty (30) days of the date of the sale at the Law Office of Michael J. Murphy, 5 Commonwealth Road, Natick, Massachusetts 01760. The description of the premises contained in said mortgage shall control in the event of any typographical error in this publication. Other terms, if any, to be announced at the time and place of sale.
