MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Koy Builders Inc. to Raymond C. Green Inc., Trustee of the Raymond C. Green Trust u/d/t May 5, 2000 and recorded with the Norfolk County Registry of Deeds at Book 14158, Page 49, said Mortgage being dated October 31, 2022 and recorded November 1, 2022 with the Norfolk County Registry of Deeds at Book 40900, Page 363 as affected by a Scrivener's Affidavit recorded at Book 40901, Page 108 and recorded September 4, 2025 and with the Middlesex South District Registry of Deeds at Book 84576, Page 170, for breach of the conditions of said mortgage and for the purpose of foreclosing same will be sold at public auction at 12:00 pm, on October 2, 2025 on or near the mortgage premises being known as 86 Glen Ellen Boulevard, Unit 46, Millis, Norfolk County and located partially in Millis, Norfolk County, Massachusetts and partially in Holliston, Middlesex County, Massachusetts, being all and singular the premises described in said mortgage to wit:
Unit No. 46 in the Regency at Glen Ellen Condominium created by Master Deed dated as of September 9, 2019 and recorded September 10, 2019 with the Norfolk County Registry of Deeds in Book 37137, Page 255, as amended of record including that certain Phasing Amendment recorded with said Registry at Book 40854, Page 37, the address of which is 86 Glen Ellen Boulevard, Millis, Massachusetts, together with an undivided .30864% percentage interest appertaining to said Unit in the common areas of said Condominium, together with the rights and easements appurtenant to said Unit as set forth in said Master Deed, as amended of record.
The Unit is shown on the Unit Plan entitled "Regency at Glen Ellen Floor Plan Unit 46, Phasing Amendment II-43", prepared by ESE Consultants, Inc., recorded in Plan Book 715, Page 97 to which is affixed a verified statement in the form prescribed by M.G.L. c. 183A, Section 8, and that fully and accurately depicts the layout of the Unit hereby conveyed, its location, dimensions, approximate area, main entrance and immediate common areas to which it has access, as built. Reference is also made to the Site Plan entitled, "Regency at Glen Ellen Condominium Site Plan, Phasing Amendment I-14, II-42 & II-43," prepared by ESE Consultants, Inc., recorded in Plan Book 715, Page 91 (the "Site Plan").
For Mortgagor's title see Deed recorded with the Norfolk County Registry of Deeds in Book 40874, Page 498 and see Deed recorded with the Middlesex South District Registry of Deeds at Book 80842, Page 339 and see Deed recorded with the Middlesex South District Registry of Deeds at Book 84576, Page 165.
The above described premises will be sold SUBJECT TO and with the benefit of all restrictions and specifically those set forth in the above referenced deeds, easements, building and zoning laws, and subject to any and all liens, unpaid taxes, tax titles, water and sewer charges, municipal or other public taxes, condominium fees and charges, assessments or liens, rights of tenants and parties in possession, if any.
TERMS OF SALE:
A deposit of TWENTY THOUSAND ($20,000.00) DOLLARS shall be required to be made to the mortgagee in cash, by certified or by cashier's check at the time and place of the sale as a deposit. The balance of the purchase price shall be paid by wire transfer, by certified check or by cashier's check within thirty (30) days thereafter at Raymond C. Green Inc., Trustee of the Raymond C. Green Trust, c/o Attorney Rosemary Traini, 100 Hallet Street, Boston, Massachusetts, in exchange for which and at such time and place, the deed shall be delivered to the purchaser for recording.
The undersigned reserves the right to change the foregoing terms of sale by announcement, written or oral, made before the auction sale, or at the commencement thereof or at the commencement of any adjourned sale.
The description of the premises contained in said mortgage shall control in the event of an error in the Notice of Mortgagee's Sale or its publication.
