By virtue and in execution of the POWER OF SALE contained in a certain mortgage given by Brian M. McKay, Bristol County, Commonwealth of Massachusetts, to St. Anne's Credit Union of Fall River, Mass., a credit union organized and existing under the laws of the Commonwealth of Massachusetts, and having its usual place of business at 286 Oliver Street, Fall River, in the County of Bristol, and Commonwealth of Massachusetts, dated August 5, 2022, and recorded with Bristol County (S.D.) Registry of Deeds, in Book 14431, Page 93, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 11 o'clock a.m. on Wednesday, the 20th day of May, 2026, on the premises, all and singular the premises described in said mortgage to wit:

The land, with any buildings thereon, situated in Fairhaven, Bristol County,
Commonwealth of Massachusetts, bounded and described as follows:
BEING shown as Parcel "B" on a plan entitled, "Plan of Land Belonging to Donald W. Lepore" dated May 22, 1978 and filed in the Bristol County S.D. Registry of Deeds in Plan Book 100, Page 37, to which plan reference is hereby made for a more particular description.
CONTAINING 15,000 square feet, more or less.
FOR TITLE, see deed from David J. Medeiros, et ux, dated June 21, 2013 and recorded in said Registry of Deeds in Book 10813, Page 305. See also deed from Donald McKay, et all, dated December 13, 2021 and recorded in said Registry of Deeds in Book 14292, Page 102.
Subject to a First Mortgage to Wells Fargo Bank, N.A. dated December 13, 2021, and recorded with Bristol County (S.D.) Registry of Deeds, in Book 14292, Page 107 as assigned to NEWREZ LLC DBA SHELLPOINT MORTGAGE SERVICING by Assignment of Mortgage dated February 5, 2026, and recorded with Bristol County (S.D.) Registry of Deeds, in Book 15382, Page 443.
Terms of Sale
Deposit of Ten Thousand and 00/100 ($10,000.00) Dollars in certified or bank cashiers check; Balance due in thirty (30) days. Delivery of deed upon receipt of balance of purchase price. Said sale shall be subject to all taxes, tax liens, municipal betterments and assessments, if any. Mortgagee reserves the right to adjourn, postpone or cancel sale up until the moment the auctioneer accepts highest bid.
The successful purchaser shall be responsible for payment of the Massachusetts Documentary Tax Stamp Fee upon delivery of the deed.
The undersigned reserves the right to change the foregoing terms of sale by announcement, written or oral, made before the auction sale, or at the commencement of any adjourned sale.
The description of the premises contained in said mortgage shall control in the event of an error in the Notice of Mortgagee's Sale or its publication.
