LEGAL NOTICE OF HEARING
PLEASE TAKE NOTICE that the Borough of Mount Arlington Land Use Board (the "Board") will hold a public "Whispering Woods" hearing on December 17, 2025 at 7:00 P.M. at the Mount Arlington Borough Municipal Building, located at 419 Howard Boulevard, Mount Arlington, New Jersey 07856 to consider: 1. revisions to a prior application made by Travis James (the "Applicant") for the Appeal of Decision of Zoning Officer and a Use Variance for a two-family dwelling for property located at 20 Oak Street and designated as Block 39, Lot 23 on the Borough of Mount Arlington Tax Map (the "Property") and located in the RA-7.5 Single-Family Residential Zone, which prior application was denied on December 18, 2024 and 2. the settlement of litigation subsequently filed by Applicant in the Superior Court of New Jersey which matter is captioned Travis James v. Borough of Mount Arlington Land Use Board bearing Docket No. MRS-L-661-25 (the "Litigation"), collectively the "Application".
Applicant makes this Application pursuant to the requirements of the Borough of Mount Arlington's Zoning and Land Use Ordinance, the Municipal Land Use Law (MLUL), N.J.S.A. 40:55D-1 et seq., and Whispering Woods at Bamm Hollow, Inc. v. Twp. of Middletown Planning Board, 220 N.J. Super. 161 (1987) which precedent governs the public hearing requirements for the settlement of litigation involving land use boards also known as a "Whispering Woods" hearing.
Applicant and Board have reached a tentative Settlement Agreement regarding the Litigation which shall be discussed at the public Whispering Woods hearing. Pursuant to the Settlement Agreement, Applicant seeks approval of the use of the Property as a two-family dwelling with a proposed Deed restriction as well as other conditions including additional screening and the like, and the Board has agreed to consider the revisions to the Application. Applicant also requests such other variances, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Board at the time of the public hearing.
All persons interested in said application may appear in person, or by agent or attorney, to participate in the meeting and present any objections that they may have to the granting of the relief sought and/or to provide public comment at the appropriate time. All documents for which approval is sought at the hearing shall be available for public inspection at least ten (10) days before the hearing during normal business hours in the office of the Land Use Board Secretary located in the Mount Arlington Borough Municipal Building, 419 Howard Boulevard, Mount Arlington, New Jersey 07856.
