PLEASE TAKE NOTICE that the undersigned attorneys for Montvale Donuts, LLC (hereinafter the "Applicant"), with the consent of the record owner, Calvin R. Douglas, of property known as 121 Chestnut Ridge Road and more formally known as Block 1901, Lot 3 on the current Tax Assessment Maps of the Borough of Montvale, New Jersey (hereinafter the "Property") previously filed an application for a use variance, preliminary and final site plan approval, bulk variances, Environmental Impact Statement waiver and soil movement to redevelop the Property. The Property is currently improved with a 1-story building and the Applicant proposes to demolish all existing structures on the Property. The Applicant proposes to construct a retail structure with drive-thru for initial occupancy by Dunkin Donuts. The plans also propose additional site improvements including parking, lighting, landscaping, etc. The Property is located in the Borough's B-1 Business District Zone.
PLEASE TAKE FURTHER NOTICE that the Applicant has applied for a Use Variance from Section 400-23B-A (a restaurant with drive-thru is a non-permitted use in the B-1 Zone). The Applicant has also applied for "C" variances from the following: Section 400-44 Limiting Schedule- Maximum Lot Coverage (60% permitted; 65.2 % proposed); Section 400-54.F.- Minimum Parking Screening Height (6 ft. required); Section 400-54E-Minimum Parking Setback from Rear and Side South Lines (10 ft required; 1.4 ft proposed); Section 400-49A.(2) Accessory Structure Location- (8 ft side yard setback required; 3 ft and 10 inches setback from the northern side property line proposed); Section 400-54.I- Minimum Sideyard Setback from Building (5 ft required; 0 ft proposed); proposed); Section 400-57.A and Section 400-57.D- Minimum Parking Spaces (70 required, 16 proposed); Section 400-54F-Parking Area Screening (6 ft minimum landscape screening required, none proposed along the southern drive aisle); Section 400-54J-Right-of-Way Improvements (sidewalk or shade trees required for new uses within the street right-of-way; no sidewalk or shade trees proposed within the Chestnut Ridge Road street right-of-way); Section 400-54K-Parking Area Shade Trees (1 shade tree for every 10 parking spaces or within 5 ft of the curb or edge of the parking area required; 2 parking area shade trees not within the parking area and greater than 5 ft from the curb proposed); and Section 400-60B- Off-Street Loading Area, none provided; Section 400-61D.(2)(a)-Make-Ready parking space (1 Make-Ready parking space where 50 or fewer parking spaces are provided is required; no Make-Ready parking space is proposed).
PLEASE TAKE FURTHER NOTICE that the Applicant will also request any and all other variances, exceptions, waivers, de minimus exceptions, interpretations and/or incidental relief from the requirements of the Borough of Montvale Ordinance that may be required by the Board after a review of the application.
PLEASE TAKE FURTHER NOTICE that the Public Hearings commenced on Tuesday, January 20, 2026 at 7:30 pm and continued thereafter with the application continuing at subsequent hearings. At the end of the Applicant's presentation, the Planning Board made additional comments and authorized the Planning Board Attorney to prepare a resolution. Prior to the adoption of the resolution, the Applicant requested the opportunity to revise their plans and for the Planning Board to reconsider their decision. The Planning Board will permit the Applicant to present revised plans and additional testimony at the Planning Board's May 19, 2026 meeting which starts at 7:30 pm and may be continued at such further time as may be further scheduled by the Planning Board of the Borough of Montvale, Municipal Building, 12 DePiero Drive, Montvale, New Jersey 07645, at which time you may appear if you so desire, before the Planning Board at the time and place designated above for the purposes of being heard with respect to this application.
PLEASE TAKE FURTHER NOTICE that all documents and plans for this application have been filed with the Planning Board at the Municipal Building, 12 DePiero Drive, Montvale, New Jersey 07645 and are available for inspection, Monday through Wednesday, 8:00 am to 4:00 pm, Thursday, 8:00 am to 6:00 pm and Friday, 8:00 am to 12:00 pm.
