MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by LARISSA A. SEIXAS AND JOEL ROSA ANASTACIO to ALFRED BLEU AND JOHN GRANT, TRUSTEES OF 17 Iris Lane Trust, said mortgage being dated August 14, 2024 and recorded with the Barnstable County Registry of Deeds in Book 36516, Page 136, of which mortgage the undersigned, ALFRED BLEU AND NICHOLAS C. SHUSAS, TRUSTEES OF 17 Iris Lane Trust, are the present holders, for breach of the conditions of said mortgage and for the purpose of foreclosing the same, will be sold at Public Auction at 2:00 o'clock P.M. on June 16, 2026, on the premises below described being located at 194 Main Street, South Dennis, Massachusetts, the above premises will be sold subject as above and subject to and/or with the benefit of any and all outstanding tax titles, municipal or other public taxes, assessments, liens, mortgages, restrictions, easements, improvements, covenants, or claims in the nature of liens, and existing encumbrances of record created prior to the aforesaid mortgage, if any there be, being described:
The land together with any buildings thereon, situated in Dennis (South), in the Commonwealth of Massachusetts, County of Barnstable, described as follows: Commencing at the Northwest corner of the premises by the County Road, thence Easterly as the fence now stands to the Northeast corner of lands of the heirs of Alfred Swift; thence Southwesterly by said Swift's land and by the fence and to the fence standing in the range of the homestead land of the late Polly Nickerson and to the late Obed Baker 2nd; thence Westerly as the fence now stands and by the North side of the barn in range of land of the Homestead of said late Polly Nickerson and Obed Baker 2nd to the County Road; thence Northerly by said road to the corner first mentioned. Subject to and with the benefit of all rights, rights of way, easements, takings, appurtenances, reservations and restrictions of record, if any there be, insofar as the same are in force and applicable. For Title see Deed recorded in Book 36516, Page 133. Said premises will also be sold subject to all leases and tenancies having priority over said mortgage, to tenancies or occupation by persons on the premises now and at the time of said auction which tenancies or occupation are subject to said mortgage, to rights or claims in personal property installed by tenants or former tenants now located on the premises and also to all laws and ordinances including, but not limited to, all building and zoning laws and ordinances, including Title 5, if applicable, if any.
Terms of Sale: A deposit of Twenty Thousand Dollars ($20,000.00) will be required to be paid by certified check by the purchaser at the time and place of sale as earnest money, with an additional deposit to be made within ten days of the sale to bring the total deposit up to ten percent of the amount bid, with the balance of the bid to be paid by certified check or wire transfer actually received on or before 2:00 P.M. July 16, 2026 at the office of Jeffery Johnson, Esquire, time being of the essence of this sale. The successful bidder shall be required to sign a Memorandum of Terms of Sale in a form to be prepared by Jeffery Johnson containing the above terms and any other terms to be announced at the sale, said memorandum to be executed at the Auction sale.
