NOTICE BOROUGH OF BIG BEAVER – BOROUGH COUNCIL Notice is hereby given that Borough of Big Beaver will consider the following proposed text amendments to the Zoning Ordinance of the Borough of Big Beaver, Ordinance 245, as amended: Article 3, Definitions: Addition of terms including but not limited to "battery(ies)," "battery energy storage system," "battery energy storage system, facility-scale," "battery energy storage system, utility-scale," "battery management system," "continuous noise equivalent level (CNEL)," "dedicated-use BESS building," "electrical substation," "module," "NFPA," "outdoor BESS installation," "sensitive receptors," "switchyard," and "transformer facility;" remove the numbering of words and phrases in section 301. Article 30, Battery Energy Storage Systems: Rename "Reserved" to "Battery Energy Storage Systems" with the addition of new subsections for Battery Energy Storage Systems, Facility-Scale (types 1 and 2) and Utility-Scale, with express standards and requirements including, but not limited to those related to purpose and applicability, permitted locations, dimensional requirements, certification and regulatory compliance, conditional use application requirements, general requirements and standards, dimensional requirements, screening and buffering, emergency management, will-serve letters, required impact studies and operational plans, decommissioning, community benefits agreements, permit submission requirements, developer's agreement, accessory power infrastructure standards, and administration and enforcement provisions. Article 43, Planning Commission: Rename "Reserved" to "Planning Commission with the addition of new subsections for Appointment, Term and Vacancy. Membership Criteria. Removal of Members. Conduct of Planning Commission Business and Powers and Duties of Planning Commission for the formation and function of the Borough Planning Commission in accordance with Article II of the Pennsylvania Municipalities Planning Code. Appendix B, Use Table: Addition of "battery energy storage systems 1, facility-scale," "battery energy storage systems 2, facility-scale" and "battery energy storage systems, utility-scale" to the Industrial land use category, as conditional uses in the Industrial District (I). The proposed ordinance is available for in-person public inspection, without charge, during regular weekday Municipal Building administrative operating hours, at the Big Beaver Borough Municipal Building 114 Forest Dr, Darlington, PA 16115. Copies of the proposed ordinance may be obtained for the cost of photocopying.
