NOTICE OF ACTIVITY AND USE LIMITATION AMENDMENT

A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On March 5, 2026, the Worcester Regional Transit Authority recorded with the Worcester County Registry of Deeds a NOTICE OF ACTIVITY AND USE LIMITATION AMENDMENT on the disposal site, pursuant to 310 CMR 40.1080 through 40.1084. The NOTICE OF ACTIVITY AND USE LIMITATION was originally recorded and/or registered on May 28, 2019.
The AMENDMENT to the NOTICE OF ACTIVITY AND USE LIMITATION is as follows:
Paragraph 1, "Activities and Uses Consistent with (select one) Maintaining No Significant Risk, is amended to read as follows:
(i) Use for commercial and/or industrial uses, including but not limited to: banking and retail; business, professional, or governmental offices; manufacturing, automotive, or industrial uses; restaurants; municipal government facilities; public utilities facilities; and pedestrian and/or vehicle traffic and vehicle parking so long as all engineered barriers and other exposure barriers (pavement, concrete, 1 ½ foot clean soil cover) are maintained;
(ii) Construction of new buildings, in accordance with applicable Massachusetts Contingency Plan (MCP; 310 CMR 40.0000) and other applicable regulations, if the vapor intrusion pathway is evaluated and appropriate vapor barriers are utilized as required by the vapor intrusion pathway evaluation and other applicable regulatory guidance, and such vapor barriers are maintained;
(v) Construction, excavation and landscaping/maintenance work that will disturb contaminated soils beneath engineered/exposure barriers provided that exposures are managed through the use of a Health and Safety Plan (HASP) prepared as specified in Section 3(iii) and such activities are performed in accordance with the Soil/NAPL/Groundwater Management Plan in Section 3 (iv);
Paragraph 2, "Activities and Uses Inconsistent with (select one) Maintaining No Significant Risk, is amended to read as follows:
(iii) Any activities that disturb engineered barriers and other exposure barriers (pavement, concrete, 1 ½ foot clean soil cover) unless such engineered/exposure barriers are repaired or replaced;
(v) Other private, public, commercial, industrial or construction activities or uses not permitted by Section 1 of this Notice which is likely to result in the direct contact with, exposure to or disturbance of non-aqueous phase liquid (NAPL) (i.e., free-phase coal tar), groundwater and/or soil unless such activities are conducted in accordance with the Obligations and Conditions in Paragraph 3 of this Notice of Activity and Use Limitation.
Paragraph 3, "Obligations and Conditions", is amended to read as follows:
(iii) A Health and Safety Plan (HASP) must be prepared by a Certified Industrial Hygienist (CIH) or other qualified individual sufficiently trained in worker health and safety requirements and implemented prior to the commencement of any planned (non-emergency) activity that is likely to disturb soil, groundwater and/or NAPL. The HASP should specify carcinogenic polycyclic aromatic hydrocarbons (cPAHs), asbestos containing material (ACM), NAPL (i.e., free-phase coal tar) as well as other chemicals present at the Site, the types of media present, the extent of impacts, the potential routes of exposure, the appropriate level of personal protective equipment, the type of monitoring required, worker safety monitoring, and hazard communication. Workers must be informed of the requirements of the HASP, and the plan must be available on-Site throughout the course of the project;
(iv) A Soil/NAPL/Groundwater Management Plan must be prepared by a Licensed Site Professional and implemented prior to the commencement of any planned (non-emergency) intrusive construction activity for the potential to encounter ACM, NAPL or other Site-related contaminants of concern. The Soil/NAPL/Groundwater Management Plan shall describe soil/NAPL/groundwater excavation, handling, storage, transport, and disposal procedures and include a description of the engineering controls and air monitoring procedures to be implemented so that workers and receptors in the vicinity are not impacted by fugitive vapors/ACM. The Soil/NAPL/Groundwater Management Plan must identify provisions to contain, collect, recover, store, and remove NAPL if it is encountered. On-site workers must be informed of the requirements of the Soil/NAPL/Groundwater Management Plan, and it must be available on-site throughout the course of the construction project;
(vii) The following maintenance and inspection activities are required to ensure the competence of the engineered barriers:
• Annual inspection of the concrete floors and subslab vent piping and overseeing repairs (if needed).
• Annual inspection of the paved area between the building and the western property boundary.
• Annual monitoring for NAPL and coal tar from the monitoring wells located on the western portion of the property.
• An Annual Site Inspection Report shall be prepared which will include photographs of the inspected areas, a description of activities conducted, and a summary of the results of sampling.
