NOTICE OF ACTIVITY AND USE LIMITATION 275 MARTINE STREET FALL RIVER, MASSACHUSETTS RELEASE TRACKING NUMBER: 4-12120 A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On September 8, 2025, M275, LLC, recorded with the Bristol County, Fall River District, Registry of Deeds a Notice of Activity and Use Limitation on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The Notice of Activity and Use Limitation will limit the following site activities and uses on the above property: (i) Removal or disturbance of the soil contaminated by oil located below the concrete basement floor, foundation, and paved areas at the Site in an area identified on Exhibit B with the exception of short term (defined as less than six months) construction and/or utility repair work which is conducted in accordance with the Soil Management Plan and Health and Safety Plan in accordance with Obligations (i) and (ii) of this Notice, and which includes the immediate replacement of the concrete floor, foundation or paved areas following completion to prevent exposure to underlying soil contaminated by oil. (ii) Any long-term (greater than six months) activity which is likely to disturb oil contaminated soil located below the concrete basement floor, foundation, and paved areas at the Site in an area identified on Exhibit B; and (iii) Relocation of oil contaminated soil currently located underneath the concrete basement floor, foundation and paved areas at the Site in an area identified on Exhibit B, unless such activity is first evaluated by an LSP who renders an Opinion which states that such relocation is consistent with maintaining a condition of No Significant Risk.
