NOTICE OF DECISION - Asbury Park
PLEASE TAKE NOTICE that on June 10, 2026, the Zoning Board of Adjustment ("Board") of the Township of Berkeley memorialized a resolution approving Application BOA#26-6148 (the "Resolution") filed by Holy Temple Church of God In Christ (the "Applicant") for use variance approval and design waivers to allow for: (i) the construction of an approximately 30-foot by 60-foot greenhouse structure with a height of approximately 18 feet; (ii) the relocation of an existing shed; (iii) the construction of a new shed and produce cooler; and (iv) related site improvements including fencing, utility connections, a gravel walkway, and other ancillary improvements (the "Application").
The Application relates to certain property located at 84 First Avenue, Toms River, New Jersey, which is known on the tax maps of the Township of Berkeley as Block 30, Lots 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, and 45 (the "Property") and which is located in the Manitou Park Rehabilitation (MPRPD) zone. The Board granted use variance relief pursuant to N.J.S.A. 40:55D-70(d) because a community garden and greenhouse are not permitted uses in the Mount Laurel Compliance Overlay Zone (the existing community garden is to remain). The Board also granted design waivers from requirements for concrete curbing, sidewalks, buffer requirements, and the accessory structure height limitation of 15 feet.
The Resolution has been filed with the Board Secretary at the Berkeley Township Municipal Complex, 627 Pinewald-Keswick Road, Bayville, New Jersey 08721, and is available for inspection.
