NOTICE OF DECISION
BOROUGH OF FAIRVIEW
ZONING BOARD OF ADJUSTMENT
PLEASE TAKE NOTICE that the Borough of Fairview Zoning Board of Adjustment (the "Board") held a public hearing on April 30, 2026, for an application by Oster Fairview Properties, LLC (the "Applicant") for amended final site plan approval and minor subdivision approval with respect to property generally located at 251-281 Broad Avenue, Fairview, New Jersey (the "Property"). The Property is identified as Block 802, Lots 1, 2, 3, and 4 and Block 801, Lots 2 & 11 on the official tax map of the Borough of Fairview and located in the Borough's B General Business Zoning District.
On April 30, 2026, the Board granted the Applicant minor subdivision and amended final site plan approval to address the conditions of the original resolution of approval for this Project, which was adopted by resolution February 22, 2024 (the "Approval"). Consistent with the prior agreement by and between the Applicant and Fairview Industrial, the Applicant will subdivide and acquire a portion of the Fairview Industrial Property (Block 801, Lot 2), which property will be combined and consolidated with the Applicant's Property identified as Block 802, Lots 1, 2, 3, and 4. Upon the recording of the Minor Subdivision and acquisition, the lots will be consolidated into a single tax block and lot which will be identified as Block 802, Lot 1.01. In addition to the foregoing, the Approval permits certain modifications to the stormwater management facilities, access driveways and parking areas, and to address other conditions of the original approval.
A copy of the Resolution of Approval, which was memorialized on May 28, 2026, is on file in the office of the Borough Clerk, at the Fairview Municipal Building located at 59 Anderson Avenue, Fairview, New Jersey, and may be viewed by the public during regular municipal business hours.
