NOTICE OF DECISION
Borough Of Fort Lee Zoning Board of Adjustment
PLEASE TAKE NOTICE that on May 26, 2026, the Borough of Fort Lee Zoning Board of Adjustment (the "Board") adopted a resolution (the "Resolution") memorializing its decision granting the application of Chabad Lubavitch on the Hudson a/k/a Chabad of Fort Lee (the "Applicant") for preliminary and final major site plan approval, as well as use variance, conditional use variance, bulk variance, and design waiver/exception relief with respect to properties having street addresses of 263-265 Warren Avenue, 808 Abbott Boulevard, and 248-250 Columbia Avenue, Fort Lee, New Jersey 07024, and being designated as Block 552, Lots 15, 16, 17 19, & 20 on the Borough of Fort Lee Tax Map (collectively, the "Property").
The Board approved Applicant's application to demolish certain improvements on the Property and to construct a three (3)-story place of worship with ancillary uses, including, but not limited to, preschool, ritual baths and community space along with related site improvements, including, but not limited to, lighting, signage, and stormwater management infrastructure, as well as retain two existing residential two (2)-family dwellings on the Property.
The Board granted use variance relief pursuant to N.J.S.A. 40:55D-70(d)(2) for expansion of the pre-existing nonconforming use on the Property.
The Board also granted use variance relief pursuant to N.J.S.A. 40:55D-70(d)(3) for failing to meet the following required conditions for a "place of worship" in the C-2 Zone, including: (1) Minimum front yard setback (25 ft. required; 0 ft. approved); (2) Minimum single side yard setback (10 ft. required; 0 ft. approved); (3) Minimum combined side yard setback (25 ft. required; 0 ft. approved); (4) Maximum lot coverage (40% permitted; 76.3% approved); and (5) No off-street parking provided where same is required.
The Board also granted use variance relief pursuant to N.J.S.A. 40:55D-70(d)(4) for maximum Floor Area Ratio ("FAR") for conditionally permitted uses in the C-2 Zone (0.6 FAR permitted; 1.6 FAR approved).
The Board also granted use variance relief pursuant to N.J.S.A. 40:55D-70(d)(6) for maximum building height for conditionally permitted uses in the C-2 Zone (30 ft. permitted; 39.18 ft. approved).
The Board also granted bulk variance and design waiver/exception relief in connection with the Application, including: (1) Fence height greater than permitted (6 ft. permitted; 7 ft. approved); (2) Fence height of solid material greater than permitted (4 ft. permitted; 7 ft. approved); (3) Fence encroachment beyond building line where same is not permitted; (4) Distance between proposed driveway and driveway on adjoining lot less than required (20 ft. required; 17.3 ft. approved); (5) Distance between proposed driveways on same lot less than required (60 ft. required; 14.7 ft. approved); (6) Driveway width less than required (15-30 ft. required; 12 ft. approved); (7) No off-street loading space proposed where same is required; (8) No landscaping buffer provided where same is required; (9) Parking for place of worship and two (2)-family dwellings less than required (135 total spaces [129 for place of worship / 6 for two (2)-family dwellings] required; 0 spaces approved); (10) Number of wall signs greater than permitted (1 wall sign permitted; 2 wall signs approved); (11) Institutional wall signs in a non-residential district greater than permitted (0 signs permitted; 2 signs approved); (12) Improved lot coverage in the C-2 Zone greater than permitted (85% permitted; 100% approved); (13) Front yard setback in R-6 Zone less than required (25 ft. required; 0 ft. approved); (14) Single side yard setback in the R-6 Zone less than required (10 ft. required; 0 ft. approved); (15) Combined side yard setback in the R-6 Zone less than required (25 ft. required; 0.4 ft. approved); and (16) Lot coverage in the R-6 Zone greater than permitted (40% permitted; 76.9% approved).
