NOTICE OF DECISION
Borough of Fair Lawn Zoning Board of Adjustment
PLEASE TAKE NOTICE that on August 25, 2025 the Zoning Board of Adjustment of the Borough of Fair Lawn (the "Board") memorialized its decision granting the application of Zachary and Chaya Berman (the "Applicant") for use variance, bulk variance, and design waiver/exception relief with respect to property having a street address of 38-55 D'Auria Drive, Fair Lawn, New Jersey 07410, and being designated as Block 1614, Lot 13 on the Borough of Fair Lawn Tax Map (the "Property").
The Board approved the Applicant's request to construct a 2nd floor addition to the existing single-family dwelling on the Property.
The Board granted use variance relief pursuant to N.J.S.A. 40:55D-70(d)(4) for Floor Area Ratio ("FAR") greater than permitted (0.37 FAR permitted; 0.52 FAR approved).
The Board also granted bulk variance relief pursuant to N.J.S.A. 40:55D-70(c) or continuation of pre-existing nonconforming conditions, including: (1) building coverage greater than permitted (25% permitted; 26.0% approved); (2) front yard setback less than required (30 ft. required; 28.2 ft. approved); and (3) side yard setback less than required (12 ft. required; 11.6 approved).
The Resolution has been filed with and is available for public inspection at the office of the Board, located at the Borough of Fair Lawn Municipal Building, 8-01 Fair Lawn Avenue, Fair Lawn, New Jersey 07410, during normal business hours.
