NOTICE OF DECISION
Pursuant to N.J.S.A. 40:55D-10(i)
PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the City of Long Branch ("Board") did, on the 9th day of February, 2026, formally adopt a Resolution memorializing the action of the Board taken at its December 8, 2025 meeting granting Avner and Sylvia Levy ("Applicants") variance approval with regard to property known as Lot 2 in Block 78 as shown on the Official Tax Map of the City of Long Branch and located 762 Hoey Avenue, Long Branch, New Jersey ("Property"). The Property also has frontage on Lake Avenue, an unimproved right-of-way.
The approval allows for the removal of the existing improvements on the Property and the construction of a new 3-story dwelling with attached garage, swimming pool and pool patio, driveway, drainage structures, and related site improvements. In conjunction with the approval, the Board granted bulk variance relief pursuant to NJSA 40:55D-70.c as follows:
Front yard setback (Hoey Avenue) to dwelling of 35 feet, and to dwelling's elevated landings of 29 feet, whereas a minimum of 50 feet is required.Front yard setback (Lake Avenue) of 23.4 feet, whereas a minimum of 50 feet is required;Rear yard setback of 36.83 feet, whereas a minimum of 50 feet is required;Side yard setback of 10 feet, whereas a minimum of 25 feet is required;Building height of 36.17 feet and being 3 stories, whereas a maximum height of 33 feet and 2.5 stories is permitted; and,Pool and pool patio located in a front yard area (Lake Avenue), whereas such structures are allowed in rear/side yards only.
PLEASE TAKE FURTHER NOTICE that the Resolution and the materials relied upon by the Board at the meetings of December 8, 2025, and February 9, 2026 are on file and available for inspection at the Office of Planning & Zoning located in City Hall, 344 Broadway, Long Branch, New Jersey.
