NOTICE OF DECISION
Pursuant to N.J.S.A. 40:55D-10(i)
PLEASE TAKE NOTICE that the Planning Board of the Borough of Deal ("Board") did, on the 24th day of March, 2026, formally adopt a Resolution memorializing the action of the Board taken at its November 25, 2025, and January 27, 2026 meetings granting Michael Tawil approvals with regard to property known Lot 1 in Block 29 as shown on the Official Tax Map of the Borough of Deal and located at 26 Wallace Road, Deal, New Jersey ("Property"). The Property is a corner lot with frontages on Wallace Road and Ocean Avenue, and currently contains a one-story single-family dwelling, freestanding garage, and related sire improvements.
The approval permits the following: convert the existing uncovered porch and paver patio into a covered front porch on the Wallace Road frontage; construct a raised landing and stairs on the rear of the house; make exterior modifications to the existing dwelling and garage; construct an in-ground swimming pool, sunken pool patio, and pool equipment; modify the front walkway on Wallace Road; add fencing; and related site improvements.
In conjunction with the approval, the Applicant was granted bulk variance relief pursuant to NJSA 40:55D-70c as follows:
Front yard setback (Wallace Road) of 38 feet to porch, whereas a minimum of 40 feet is required. Building coverage of 23.65%, whereas a maximum of 20% is permitted. Side yard (south) setbacks of 29.18 feet to raised landing and 10.19 feet to steps, whereas a minimum of 35 feet is required. Side yard (south) setback of 20.21 feet to pool and 19.69 feet to pool patio, whereas a minimum of 30 feet is required.
PLEASE TAKE FURTHER NOTICE that the Resolution and materials relied on by the Board at the meetings of November 25, 2025, January 27, 2026, and March 24, 2026, are on file at the office of the Board located at Borough Hall, 190 Norwood Avenue, Durant Square, Deal, New Jersey.
