NOTICE OF DECISION
Pursuant to N.J.S.A. 40:55D-10(i)
PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the City of Long Branch ("Board") did, on the 11th day of May, 2026, formally adopt a Resolution memorializing the action of the Board taken at its April 13, 2026 meeting granting Matthew and Tara Kelly ("Applicants") approvals with regard to property known as Lot 26 in Block 257 as shown on the Official Tax Map of the City of Long Branch and located 37 Washington Street, Long Branch, New Jersey ("Property"). The Property contains a preexisting nonconforming two-story two-family dwelling, driveway, and related site improvements.
The approval permits the following: renovations to the existing two-family dwelling and the construction of a new two-story addition; construction of a new one-story detached garage with two separated bays (one for each dwelling unit); reconfiguration and expansion of the existing driveway leading to the new garage; drainage improvements; and, related site improvements.
In conjunction with the approvals, the Board also granted the following relief:
Certification of preexisting nonconforming use pursuant to NJSA 40:55D-68 confirming that the two-family use legally existed prior to October 22, 1969, the date in which the use was rendered nonpermitted.
Use variance relief pursuant to NJSA 40:55D-70.d.2 to allow for the expansion of the preexisting nonconforming two-family use.
Bulk variance relief pursuant to NJSA 40:55D-70.c for: Side yard (north) setbacks of 3.7 feet to the existing two-family dwelling and 3.96 feet to the new addition, whereas a minimum of 10 feet is required. Lot frontage of 50 feet, whereas a minimum of 65 feet is required for a two-family dwelling. Lot coverage of 43%, whereas a maximum of 40% is permitted.
PLEASE TAKE FURTHER NOTICE that the Resolution and the materials relied upon by the Board at the meetings of April 13, 2026 and May 11, 2026 are on file and available for inspection at the Office of Planning & Zoning located in City Hall, 344 Broadway, Long Branch, New Jersey.
