NOTICE OF DECISION
Pursuant to N.J.S.A. 40:55D-10(i)
PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Borough of West Long Branch ("Board") did, on the 19th day of May, 2026, formally adopt a Resolution memorializing the action of the Board taken at its April 21, 2026 meeting granting Consumer Centre Paramount 1, LLC ("Applicant") approvals with regard to property known as Lot 8.03 in Block 67 as shown on the Official Tax Map of the Borough of West Long Branch ("Borough") and located at 310 New Jersey State Highway Route 36 ("Route 36"), West Long Branch, New Jersey ("Property"). The Property is located in the Borough's HC Highway Commercial Zone ("HC Zone") and is currently developed with the Consumer Centre Shopping Plaza. A portion of the driveway accessing the Property traverses a small triangular parcel fronting on Route 36 adjacent to the Property to the northwest, known as Lot 6 in Block 2801 as shown in the Official Tax Map of the Borough of Eatontown.
Applicant was granted the following approvals:
Preliminary and final site plan approval to construct an approximately 1,900 square foot freestanding "Starbucks" restaurant with drive-through along with adjacent parking, signage, landscaping, and related site improvements.
Use variance relief pursuant to NJSA 40:55D-70.d.1 for:
Two principal structures on one lot, whereas only one principal structure is permitted on a lot. A freestanding limited service restaurant building within a shopping center, whereas such uses are only permitted in the HC Zone when physically annexed to a shopping center use.
Bulk variance relief pursuant to NJSA 40:55D-70.c for: Lot coverage of 84.1%, whereas a maximum of 65% is permitted. Drive aisles of up to 30 feet in width, whereas a maximum of 25 feet is permitted. Passenger loading zone access aisle length of 18 feet, whereas a minimum of 20 feet is required. Providing 1,126 off-street parking spaces, whereas a minimum of 1,497 parking spaces is required. Four (4) façade signs on the Starbucks building, whereas a maximum of two (2) façade signs are permitted. Two (2) freestanding signs (one existing and one proposed for the Starbucks building), whereas a maximum of one (1) freestanding sign is permitted. Freestanding sign area of 56 square feet in total (28 square feet per side), whereas a maximum total area of 50 square feet is permitted for one sign. Freestanding sign setbacks of 10 feet from property line and 4 feet from parking area, whereas a minimum of 20 feet is required for each.Lack of required buffer zone, whereas a 25-foot wide buffer zone with a 6-foot high screen fence or hedge is required along side and rear property lines.
