NOTICE OF DECISION
Please take notice that the Borough of Haddonfield Zoning Board of Adjustment ("Board") has granted an application for development filed by Tyler Yelk and Elyce Yelk (collectively, the "Applicants") regarding real property located at 280 Merion Avenue, designated as Block 11.04, Lot 5.12 on the municipal tax map. The property is currently improved with an existing one-story single-family home. The Applicants propose to construct a 946 SF second-story addition on the existing one-story home and a covered porch extension. The Board granted the following variances under the Borough Ordinance:
1. A variance from §135-30D(2)(a) which states the minimum front yard in this district is determined by using a Front Yard Analysis as described in Attachment 7. The front yard analysis shows that the front yard setback along Merion Avenue is 34.01 FT. The existing front yard is 22 FT. The proposed steps scale to 16.2 FT and the proposed porch creates a front yard setback of 17.67 FT.
2. A variance from §135-30D(2)(a) which states the minimum front yard setback is 44.92 FT (averaging) along the Grove Street frontage. The existing front yard setback is 44.6 FT. The proposed 2nd story addition's front yard setback is 44.6 FT.
3. A variance from §135-30D(2)(b) which states the minimum side yard (one side) setback in this district is 12 FT. The existing side yard setback on the south side is 6.83 FT. The proposed 2nd floor will have a side yard of 8.83 FT which does not meet side yard setback requirements.
4. A variance from §135-30D(2)(c) which states the minimum side yard (both) in this district is 30 FT. The existing side yard setback (both) is 29.8 FT. While the side yard setback (both) does not change with the proposed improvements, the proposed improvements do not bring side yard setback (both) into conformance.
5. A variance from §135-30D(4)(a) which states the maximum building coverage in this district is 20%. The existing building coverage is 22.1%. The proposed building coverage is 22.9%.
6. A variance from §135-30D(4)(b) which states the maximum impervious coverage in this district is 32%. The existing impervious coverage is 35.6%. The proposed impervious coverage is 34%.
Be it further resolved that an Existing Non-Conforming Condition has been identified and is acknowledged as follows:
From §135-30D(1)(d) which states the minimum lot depth is 100 FT. Due to the nature of the parcel, the existing lot depth on the Merion Avenue Frontage is 45.96 FT.
Be it further resolved that the approval(s) hereby granted are made subject to the following General Conditions applicable to this type of application. And be it further resolved that the approvals hereby granted are made subject to the following Additional Conditions of Approval, and as further detailed herein, at the time of the hearing(s), in the professional review letter(s) identified and identified as follows:
1. Applicant agrees to all comments, requests and recommendations as listed in the ERI review letter dated August 14, 2025.
2. Applicant agrees to design and install a stormwater management system satisfactory to address the 10 year storm and to address the increase in impervious coverage, in a manner and in a location acceptable to the Board Engineer.
3. Applicant agrees to provide an updated grading plan with engineering scale.
4.Applicant agrees to provide revised plans detailing that the roof drains will not be directed to the neighbors, and in addition that there will be a reduction of approximately 140 SF of impervious coverage that was initially proposed with the application, reducing the proposed impervious to 34%.
5. Applicant agrees that the proposed improvements will not cause any adverse drainage conditions on the PIQ or on any adjoining parcels.
The Board approved this application on August 19, 2025, and its decision was memorialized in a written resolution that the Board adopted on September 16, 2025. A copy of the memorialized resolution is filed in the office of the municipal administrative officer. A copy is available to any interested party for a reasonable fee and is available for public inspection during municipal business hours.
