NOTICE OF DECISION
Please take notice that the Borough of Haddonfield Zoning Board of Adjustment ("Board") has granted an application for development filed by Paul Sabelli ("Applicant") regarding real property with a street address 127 Fowler Avenue and designated as Block 33, Lot 50 on the current municipal tax map. The Board granted a D(2) variance to permit the construction of a second story addition directly above and within the existing footprint of the single-story portion of the dwelling
The Board also granted the following variances under the municipal land use ordinance:
1. Section 135-34A which states a twin home is not a permitted use in this zoning district. The proposed improvements are an expansion of an existing, non-conforming use.
2. Section 135-34D(2)(b) which states the side yard setback is 4 ft in this zoning district. The dwelling is located on the property line, with a 0 ft setback. The proposed improvements will construct a 2nd story above the first floor. The 2nd story does not meet the requirements of the zoning district.
3. Section 135-34D(4)(a) which states the maximum building coverage in this district is 30% where the existing building coverage is 33.07%. It is unclear what the proposed building coverage is. The area of the cantilevered 2nd floor should be determined and the building coverage re-calculated. This area scales to approximately 40 sf and increases the building coverage to 34.37%.
4. Section 135-34 (D)(2)(d) which states 25 ft is the minimum required rear yard setback and 8.25 ft is existing and approved;
5. Section 135-34(D)(2)(c) requires a minimum rear yard setback of 25 ft. The current rear yard setback is approximately 10.62 ft. A rear yard setback of 8.25 ft is proposed for the proposed addition;
6. Section 135-34D(l)(a), the minimum lot area in this zoning district is 4,000 sf where a lot area of 3,098 sf exists. Existing non-conformity, no change;
7. Section 135-34D(l)(d), the minimum lot depth is 100 ft in this zoning district where a lot depth of 42.51 exists. Existing non-conformity, no change.
The Board granted this application on January 20, 2026 and its decision was memorialized in a written resolution that the Board adopted on February 17, 2026. A copy of the memorializing resolution is filed in the office of the municipal administrative officer. A copy is available to any interested party for a reasonable fee and is available for public inspection during municipal business hours.
