NOTICE OF DECISION
Please take notice that the Pennsauken Township Planning Board ("Board") has granted an application for development filed by Pollos Don Pedro LLP ("Applicant") regarding real property with a street address 3022 Marlton Pike, designated as Block 6717, Lot 22 on the current municipal tax map. The property is currently improved with a one-story commercial building that was previously used as a food market and deli. The Applicant proposes to change the use to a restaurant use, which is a permitted use in the C-1 zone. The Board granted change of use, minor site plan approval and bulk variances for the proposed restaurant.
The Board approved the following variances under the municipal land use ordinance:
1. Section 141-81(B) states a minimum lot width of 50 ft is required. The existing lot width of 48 ft. was approved (existing nonconforming condition);
2. Section 141-81(C)(2)(a) states a minimum front yard setback of 40 ft is required. The existing front yard setback of 16.1 ft. was approved (ENC);
3. Section 141-81(C)(2)(b)(2) states a minimum single side yard setback of 10 ft is required. The existing single side yard setback of 0.29 ft on the left side and 1.52 ft on the right side were approved (ENC);
4. Section 141-81(C)(2)(c) states a minimum rear yard setback of 35 ft is required. The existing rear yard setback of 3.5 ft. was approved (ENC);
5. Section 141-81(C)(3)(a) states a maximum building coverage of 50% is permitted. The existing building coverage of 69.7% was approved (ENC);
6. Section 141-81(C)(3)(b) states a maximum lot coverage of 85% is permitted. The existing lot coverage of 92.63% was approved (ENC);
7. Parking spaces must be a minimum of 10 ft x 20 ft. The existing parking space size of 9 ft x 16 ft to 9 ft x 18 ft were approved (ENC);
8. ADA parking spaces must be a minimum of 12 ft x 22 ft. ADA parking space of 20 ft x 18 ft was approved (ENC);
9. Section 141-87(D) requires a minimum of 1 loading space. The Board granted a variance from the requirement to provide a loading space (ENC);
10. Section 141-87(A)(2) states 12 off-street parking spaces are required. The Board approved four (4) on-site spaces (ENC); and
11. Section 141-81(E) states that off-street parking shall be arranged such that no vehicles shall back directly from off-street parking into a public street. The Board granted a variance to permit vehicles to back out from the off-street parking spaces into a public street (ENC).
The Board granted this application on February 3, 2026 and its decision was memorialized in a written resolution that the Board adopted on March 3, 2026. A copy of the memorializing resolution is filed in the office of the municipal administrative officer. A copy is available to any interested party for a reasonable fee and is available for public inspection during municipal business hours.
