LAND DEVELOPMENT BOARD
PLEASE TAKE NOTICE that on June 4, 2026 the Land Development Board of the Township of Southampton (the "Board") adopted a resolution (the "Resolution) memorializing its decision of May 7, 2026 to approve an application for minor site plan approval along with bulk variance relief (the "Approval") filed by Public Service Electric and Gas Company, the owner and applicant (the "Applicant" or "PSE&G"), with respect to property located at 515 New Road and designated as Block 1904, Lot 1.03 on the Tax Maps of the Township of Southampton (the "Property"). The Property is located in the Township's Rural Development (RD) Zone (the "RD Zone"), which is also located in the Pinelands Management Area.
The Property is currently used as a public utility installation – electrical substation known as the Southampton Substation (the "Station"). The Station has been in operation since the early 1960s and will remain a public utility following completion of the proposed improvements. The Approval granted minor site plan approval along with bulk variance relief in order for the Applicant to upgrade the existing substation by replacing the aging 13kV switchgear unit with a new one. The Approval also allows the Applicant to install electric vehicle charging stations for use by PSE&G fleet vehicles along with an associated transformer as well as two (2) new station light and power transformers. The Approval allows the replacement in-kind of the existing eight (8) foot tall chain link fence around the perimeter of the substation with an eight (8) foot tall anti-cut anti-climb fence. The Board also approved the installation of new underground duct bank and macadam access drives throughout the Property. Finally, the Approval allows for the removal of certain landscaping, but is the Applicant proposed a number of new plantings.
During the May 7, 2026 hearing, the Board interpreted "The Land Development Ordinance of the Township of Southampton" (the "Ordinance") and determined that the public service infrastructure is a permitted principal use in the RD Zone and that the proposed improvements are not subject to the conditional use standards. As a result, the Board interpreted that the Applicant no longer needed the following variance relief from the Ordinance: (1) variance relief from Section 12-5.9 of the Ordinance to permit an impervious coverage of 34.6% (with 37.5% being the existing impervious coverage), whereas a maximum of 1% is permitted and (2) variance relief to continue a pre-existing nonconformity to have a front yard setback of 34.7 feet and 45.8 feet, whereas a minimum of 50 feet is required. The Board did, however, grant variance relief to permit a lot area of 3.56 acres, whereas a minimum of 25 acres is required.
