NOTICE OF DECISION
Township of Old Bridge Zoning Board of Adjustment
PLEASE TAKE NOTICE that on June 4, 2026 the Township of Old Bridge Zoning Board of Adjustment (the "Board") adopted a resolution (the "Resolution") memorializing its decision granting the application of Bergen Concepts LLC (the "Applicant") for preliminary and final major site plan approval along with use variance, bulk variance, and design waiver/exception relief with respect to property having a street address of 3699 Route 9 (a/k/a 3699 Hwy 9), Old Bridge, New Jersey 08857, and being designated as Block 13000, Lot 9.12, on the Tax Map of the Township of Old Bridge (the "Property").
The Board approved Applicant's application to construct a double-sided billboard consisting of approximately 672 sq. ft., and relocate and replace the existing gas station freestanding and pricing sign on a portion of the Property.
The Board granted use variance relief pursuant to N.J.S.A. 40:55D-70(d)(1) for the erection of a billboard (digital) where same is not permitted. The Board also granted use variance relief pursuant to N.J.S.A. 40:55D-70(d)(1) for multiple principal uses and structures on a property. The Board also granted use variance relief pursuant to N.J.S.A. 40:55D-70(d)(6) for maximum structure height greater than permitted (30 ft. permitted; 55 ft. approved).
The Board also granted bulk variance and design waiver/exception relief in connection with the Application, including: (1) front yard setback (Route 9) less than required (30 ft. required; 0 ft. (sign face) and 17.1 ft. (sign post) approved); (2) front yard setback (Spring Valley Road) greater than permitted (50 ft. permitted; 156.6 ft. (sign face) and 169.8 ft. (sign post) approved); (3) side yard setback (west) less than required (25 ft. required; 0.0 ft. (sign face) and 17.1 ft. (sign post) approved); (4) rear yard setback less than required (50 ft. required; 10.1 ft. (sign face) and 27.2 ft. (sign post) approved); (5) landscape area ratio less than required (0.40 required; 0.31 approved); and (6) front yard setback to monument sign less than required (10 ft. required; 2 ft. approved).
The Resolution has been filed and is available for public inspection at the office of the Board, located at the Township of Old Bridge Municipal Building, 1 Old Bridge Plaza, Old Bridge, New Jersey 08857, during regular business hours.
