NOTICE OF ENACTMENT OF ORDINANCE AMENDING THE CODE OF THE TOWN OF MCMILLAN
PLEASE TAKE NOTICE that on May 11, 2026, the Town Board of the Town of McMillan enacted Ordinance No. 2026-01 titled "An Ordinance Amending the Code of the Town of McMillan Part II: General Legislation Creating Chapter 507. Wind Energy Systems".
Summary of Ordinance: The Town Board has created Chapter 507 of the Town Code to regulate the siting, installation, and operation of Wind Energy Systems (WES). Key components of the ordinance include:
Legislative Intent: Findings that WES can have adverse impacts on public health, safety, and welfare, necessitating local regulation.Applicability: Applies to all WES with a nameplate capacity of 300 kilowatts or greater, as well as "Small" WES (300 kilowatts or less).Permitting and Licensing: Establishes a local approval process requiring pre-application consultation, public notice, and the issuance of a Wind Energy System License.Siting Standards: Defines mandatory setbacks from property lines, public roads, and residences (e.g., 1,250 feet or 3.1 times the blade tip height for nonparticipating residences).Operational Standards: Implements strict criteria for noise limits (50 dBA daytime/45 dBA nighttime) and shadow flicker (maximum 30 hours per year).Decommissioning: Requires owners to remove systems at the end of their useful life and provide financial assurance for projects 1 MW or larger.Enforcement: Outlines penalties for violations, including stop-work orders, forfeitures, and recovery of enforcement costs.
Effective Date: This Ordinance shall be in full force and effect from and after its date of adoption and notice to the public as required by law.
