NOTICE OF FORECLOSURE BY ADVERTISEMENT
Default having been made in conditions of a certain Mortgage made by RICHARD R. GRIFFITH and TERRENCE R. WARNER, to TERRENCE R. WARNER, TRUSTEE OF THE TERRENCE R. WARNER LIVING TRUST DATED OCTOBER 14, 2010, dated December 10, 2010, and recorded in the office of the Register of Deeds for the County of St. Clair, and State of Michigan, on December 14, 2010, in Liber 4094, page 432 et seq., on which Mortgage there is claimed to be due as of April 10, 2026, for principal and interest, the sum of One Hundred Thirty Thousand Two Hundred Fourteen and 56/100 Dollars ($130,214.56), and no proceedings having been instituted to recover the debt now remaining secured by said Mortgage, or any part thereof, whereby the power of sale contained in said Mortgage has become operative.
THEREFORE, Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at the front steps of the County Building, 201 McMorran Boulevard in the City of Port Huron and County of St. Clair, Michigan, that being the place of holding the Circuit Court in and for said County, starting promptly at 1:00 p.m. local time of said day, on: THURSDAY, MAY 14th, 2026, or any adjourned date thereafter, by public auction sale to the highest bidder for cash or cashier's check. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information.
The premises will be sold to pay the amount so as aforesaid then due on said Mortgage together with ten percent (10.0%) per annum interest, legal costs, attorneys' fees and also any taxes and insurance that said Mortgagee, Terrence R. Warner Living Trust dated October 14, 2010, does pay on or prior to the date of said sale; which said premises are situated in the City of Algonac, St. Clair County, Michigan, and more fully described in said Mortgage as follows, to-wit:
Lots 7 and 8, Sherwoods Golfview Subdivision, according to the plat thereof as recorded in Liber 48 of Plats, Page 13, St. Clair County Records.

The length of the period of redemption from such sale is six months immediately following said sale, unless determined abandoned in accordance with MCL 600.3241, in which case the redemption period shall be 30 days from the date of such sale.
If the property is sold at a foreclosure sale under this MCL 600.3201 et seq., under MCL 600.3278 the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period.
