NOTICE OF FORFEITURE OF OIL AND GAS INTERESTS Notice is hereby given to The Midland Oil Company, The Waverly Oil Works Company, Moran Oil Partners, LLC, Jimmy Walton, Kenneth R. Miller, Jack K. Miller, Max A. Miller, Jane K. Grosjean, and Marjorie A. Allen, as successors-in-interest or potential successors-in-interest to The Carter Oil Company, in the Oil and Gas Lease dated August 24, 1917, given by Martha J. Gutridge, a widow, as lessor, to The Carter Oil Company, as lessee, covering 107 acres, more or less, in in Hopewell Township, Licking County, Ohio, which was recorded in Volume 34, Page 50 of the Lease Records of Licking County, Ohio ("Lease"), of the intent of Thomas Baker and Jennifer Baker (collectively "Lessors") to declare that the Lease has been forfeited. Said Lease recited that it covered the following described land: The premises situate in Hopewell Township, Licking County and State of Ohio, bounded and described as follows: On the North by lands of G.W. Gutridge & B. V. Hupp; On the East by lands of G. D. Orr Estate; On the South by lands of T. B. Iden & J. R. Graham; On the West by lands of Sarah Gutridge. Lessors own 103.879 acres covered by the Lease. In accordance with Section 5301.332 of the Ohio Revised Code, Lessors do hereby notify you, as a successor-in-interest to Lessee, of their intent to declare that the Lease has been forfeited because the term of the Lease has expired. The Lease has been forfeited because the term was to extend beyond August 24, 1927, only for as long as oil and gas was found in paying quantities and there is currently no production of oil and gas from the lands covered by the Lease. Therefore, the Lease has been forfeited. It is the intent of Lessors to file an affidavit of forfeiture with the Licking County Recorder if the successors-in-interest to Lessee do not have the Lease released of record within 30 days from the date of receipt of this Notice of Forfeiture.
