NOTICE OF FORFEITURE OF OIL AND GAS LEASE
(Ohio Revised Code § 5301.332)
To:
Seagull Development Corp., and its successors and assigns, whose last known addresses are: P.O. Box 505, Canal Fulton, Ohio 44614; and 2740 Doral Circle SE, Massillon, OH 44646.
D&D Energy Co., and its successors and assigns, whose last known address is: 6033 Marelis Ave. NE, North Canton, OH 44721.
Please be advised that Elizabeth A. Schuring, as successor-in-title to Wynn L. Schuring and Elizabeth A. Schuring, husband and wife ("Lessor"), is the current lessor under that certain Oil and Gas Lease dated May 5, 1982, as recorded in Official Records Book 23, Page 329 of the Stark County, Ohio Recorder's Office, and re-recorded in Official Records Book 68, Page 364 of the Stark County, Ohio Recorder's Office, as assigned under that Assignment of Oil and Gas Lease dated May 19, 1982, as recorded in Official Records Book 59, Page 31 of the Stark County, Ohio Recorder's Office, and as further assigned under that Assignment, Bill of Sale, and Agreement dated September 25, 1996, as recorded in Official Records as Instrument Number 1996069952 of the Stark County, Ohio Recorder's Office (collectively, the "Lease") and Seagull Development Corp. and D&D Energy Co. are the successors-in-interest to the original lessee, Eastern Energy ("Lessees").
The Lease covers certain real property containing approximately 19.50 acres of land and is described as follows:
Section 29, Township of Osnaburg, County of Stark, State of Ohio, bounded substantially as follows now or formerly:
On the north by lands of Mapleton Av.
On the east by lands of W. Bowers
On the south by lands of Stark Ceramics
On the west by lands of G. Liotti
And containing 19.50 acres, more or less, and affecting 19.50 acres as conveyed to Elizabeth A. Schuring ("Lessor"), by Certificate of Transfer dated March 2, 2010, and recorded in Official Records as Instrument Number 201003020007511 of the Stark County, Ohio Recorder's Office;
It being intended hereby to include herein all lands and interests therein contiguous to or appurtenant to the land owned or claimed by Lessor;

The Lease will be declared forfeited and void because the Lessees and their heirs, successors, and assigns have abandoned and forfeited the Lease due to the following:
1. No operations for oil and gas are being conducted on the land;
2. No shut-in royalties have been paid;
3. No wells are currently producing oil or gas in paying quantities on the land;and
4. No formation underlying the land is used for storing gas.
For the foregoing reasons, the Lessor intends to record an Affidavit of Forfeiture pursuant to Ohio Rev. Code § 5301.332 with the office of the Recorder of Stark County, Ohio if the Lease is not released of record by Lessees within thirty (30) days from the date of publication of this notice.
