NOTICE OF FORFEITURE OF OIL AND GAS LEASE Pursuant to Ohio Revised Code Section 5301.322 To: VAR Services, LLC ("VAR Services"), its successors and assigns, Attn: Allen W. Rowles, Jr., whose registered address is 889 Michaelis Road, Marietta, Ohio 45750. Please be advised that Randy Raber, Trustee of the Red Hill Farm Trust, is the current lessor under that certain Lease between Richard Shaw, as original lessor, and Fred Wood, as original lessee, for 169 acres in Sections 5 and 6 in Cambridge Township, Guernsey County, Ohio, dated June 3, 1980 and recorded in Volume 87, Page 11, Guernsey County Official Records (the "Lease"). The Lease encumbers that certain real property being approximately 169 acres, further identified as Guernsey County Tax Parcel Numbers 02-0003876.000 and 02-0003870.000, located in Cambridge Township, Guernsey County, Ohio and being more particularly described in Volume 75, Page 464, Guernsey County Official Records (the "Property"). The Lease was for a primary term of one (1) year beginning on June 3, 1980, and continuing "as long thereafter as oil or gas, or either of them, is produced from said land by the lessee." According to records maintained by the Ohio Department of Natural Resources ("ODNR"), VAR Services is listed as the operator of the Blackwell Well No. 2 located on the Property and subject to the Lease. Red Hill Farm Trust has not received any royalties, delay rentals or shut in fees in over five years and ODNR records indicate that the well has not produced since 2019. As such, the Lease has expired in accordance with its terms for failure to produce in paying quantities. Red Hill Farm Trust attempted to serve VAR Services on January 28, 2026 via certified mail; however, such notice letter was returned to sender. Accordingly, this publication to VAR Services, its successors and/or assigns, shall serve as formal notice of Red Hill Farm Trust's intention to declare the Lease forfeited pursuant to Ohio Revised Code Section 5301.322. If the Lease is not released within thirty (30) days from publication of this Notice, Randy Raber, as Trustee of the Red Hill Farm Trust, intends to file for record an affidavit of forfeiture with the Guernsey County Recorder.
