NOTICE OF FORFEITURE OF OIL AND GAS LEASE

NOTICE OF FORFEITURE OF OIL AND GAS LEASE Pursuant to Ohio Revised Code Section 5301.322 To: Vortex Energy, LLC, its successor and assigns, whose address of record with the Ohio Secretary of State is 54888 Red Lane Road, Cumberland, Ohio 43732. Multiple attempts to notice Vortex at the address of record have been unsuccessful, as a last resort Vortex Energy, LLC is hereby notified: Please be advised that William G. Kurtz, Linda R. Kurtz, John H. Kurtz, Raymond W. Kurtz and Sameul W. Kurtz are the successors in interest to lessors Herbert F. Cowgill and Martha C. Cowgill (the "Lessors") under that certain lease with G.R. Stocker as lessee for 253 acres located in Section 21 in Spencer Township, Guernsey County, Ohio, dated September 22, 1964 and recorded in Volume 54, Page 912-914, Guernsey County Official Records (the "Lease"). The Lease encumbers that certain real property being approximately 253 acres, further identified as including a part of Guernsey County Tax Parcel Number 36-0000057.001, located in Spencer Township, Guernsey County, Ohio and being the Northeast Quarter and part of the Northwest Quarter, Township 9, Range 10, Section 21 (the "Property"). The Property is more particularly described in that certain Warranty Deed recorded in Volume 585, Page 3837, Guernsey County Official Records. The Lease was for a primary term of 10 years beginning on September 22, 1964, and "as long thereafter as operations described above are being conducted on the premises or oil and gas is produced in marketable quantities." According to the records maintained by the Ohio Department of Natural Resources, the wells identified as the Cowgill-Howell No. 1 (API Well #- 34059216390000), Cowgill-Howell No. 3 (API Well #- 34059216920000), Cowgill-Howell No. 6 (API Well #- 34059217980000), Cowgill-Howell No. 7 (API Well #- 34059218470000, Cowgill-Howell No. 8 (API Well #- 34059218390000) have not produced any gas or hydrocarbons since 2017. Additionally, Lessors have not received any royalties, delay rentals, or shut in fees. As such, the Lease has expired in accordance with its terms for failure to keep any maintain production beyond the primary term. This notice to Vortex Energy, LLC, its successors and/or assigns, shall serve as formal notice of Lessors intention to declare the Lease forfeited pursuant to Ohio Revised Code Section 5301.322. If the Lease is not released within thirty (30) days from publication of this Notice, the Lessors intend to file for record an affidavit of forfeiture with the Guernsey County Recorder.
